Do I have enough evidence to file k-1 forms?

okay, i've got my I-129F completeted, both of our G-325A's completed. proof of citizenship, my fiances birth cert. & copies of her passport. now i'm worried about getting a RFE, this is what i have.

Proof of having met in person in the last 2 years: A RECEIPT of my trip to philippines printed on a Cathay Pacific boarding pass ticket. it shows flight #'s and dates (my actual boarding passes were destroyed in a small garage fire). my passport w/ philippine date stamps. 8 receipts from resorts we went to while i was there. my cell phone records showing calls made on my phone from within the philippines. 6 pictures of us together.

Proof of an ongoing relationship: western union money transfer receipts (9 total), my cell records from the last year-call & text. copies of the envelopes we sent cards & letters to each other (6 total).

I think it's enough, do you?

You don't need proof of an ongoing relationship at this time. You do not need cell phone records for this stage either. Here is what USCIS wants:

Submit evidence of meeting the meneficiary in person within the two-year period preceding the filing of the petiition. The primary evidence may include airline ticket stubs and receipts (that indicate month, day, and year), copies of passport pages taht show the identification page and admission stamps, military order(s), letter from Commanding Officer, or any evidence that will help the USCIS to determine that the petitioner has met the beneficiary within the two years. The secondary evidence may be film dated photographs of the petitioner and the beneficiary together. The following DOES NOT constitue evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards."

Your receipts and your passport stamps sound like good primary evidence. You have some photos as secondary evidence. Emails and phone bills do nothing for your I-129F filing. It sounds like you should be okay. If you are concerned, you may be able to get some sort of proof of travel (duplicate boarding pass, etc) from the airline, but with the copy of the itinerary and the passport stamps, you should be covered.

This is my personal opinion so by all means feel free to ignore what I am going to say:

I think everything looks good. For the petition you do not need proof of an ongoing relationship...that is required at the interview stage so I would suggest keeping that for then.

I am also not sure that they need your fiance's birth certificate or copies of her passport (unless there are passport stamps in there for the proof of having met during the past 2 years).

Do you have the statements of intent to marry (examples can be found on this website)? I didn't see that on your list.

Otherwise it looks like you are good to go!

If you want to send extra stuff like proof of relationship and so on, go ahead, i did, and nothing bad happened, tho you will need to present that again at the interview. Other than that, send everything on the list that USCIS needs from you and you will be fine. good luck!!!

Letters are good, but don't stress about sending them now. That quoted text is from the horse's mouth - not made up - and is good information. Including them won't hurt you - but it won't help either. Make sure, if you elect to send unnecessary items, that you send ONLY COPIES and keep the originals. You can use them later at the interview (though you'll want to gather some new letters and phone bills from the time between filing and the interview as well).

Don't panic - including the right evidence is easy once you know what it is. USCIS should include the information I quoted above (from RFE letters received by many people) in the instruction form on the I-129F. But they don't.

how would money transfers cause suspicion of fraud? they are going to her not to me, and its common since why i would send her money. she lives in the Philippines, the economy isn't that great. i love her..anything i can do to make her life a little easier, is going to happen. IMO the money transfers is a no brainer.

These are the basic steps required by the US Citizen. These steps should be followed as a guideline and not as specific requirements for any given case. Every case is unique and this does not address that uniqueness.

Download the Following Forms:

1. I-129F

2. G-325a

The above forms can be filled out on your computer and printed. Make sure you sign and date them as required. Anything you cannot fit by typing, you can handwrite (very neatly) in black ink in the blank instead. You should always verify the current forms at www.uscis.gov.

Assembling the I-129F Package: Checklist

Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.):

1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted.

2. Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

3. Form I-129F: Petition for Alien Fiance(e) (see example)

4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.

5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)

6. Proof of having met in past two years. (click here for examples)

7. G-325A (all four pages) filled out by the US Citizen signed and dated (see example)

8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

9. G-325A (all four pages) filled out by the foreign fiance(e) signed and dated (see example)

10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.

13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum,

but the more you can provide the less likely you are that you will receive an RFE. 1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.

2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as ofoto.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.

3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

Mail the I-129F Package to the USCIS

Section 12 of the I-129F instructions lists where you should mail the completed form(s). If you live in the United States this will be the Service Center with jurisdiction over the petitioner's place of residence. Mail the package with return receipt requested / delivery confirmation. Send via USPS.

IMPORTANT!

Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain ALL original supporting Evidence since the USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence.

Step one: calm down.

Step two: assess advice - and that's all it is - and see what you think about it. Include what you want. Exclude what you want. One member offered his advice. You are free to take it or leave it - but not to freak out about it since YOU asked for advice!

I can't comment on concerns that may be faced by filers from high-fraud countries. I am dealing with a lower-fraud country. Different concerns arise at different Embassies around the world.

At this point, for WHATEVER reason given for not including evidence of financial support, the bottom line is YOU DON'T HAVE TO INCLUDE IT. It will do NOTHING to prove to USCIS what you need to prove. Save it for later, or leave it out entirely. It. Will. Not. Help. You. Get. Approved. At. This. Stage. Period. Full. Stop.

Not trying to be bitchy about this, but it's important to understand exactly WHY you would be including any particular piece of evidence. If it isn't included for a reason, then it shouldn't be included at all.

You need to prove:

1.) that you have met within the past 2 years in person

2.) that you intend to marry.

Past that, you're just stressing yourself out. Money transfers, phone bills, letters, all of these are immaterial to your proof as USCIS requires it.

Really, best advice is to remain calm, read as much as you can, educate yourself, and make your decisions as you will. Cutting and pasting in the guides isn't going to help you.

I see you have got a lot of advice and good information to help you through, to file for a K-1 visa.

I would like to tell you what I sent in with the I-129f. I had no clue about this site before sending the petition, so I had a lady help me with it, who was familiar with it. Whether or not this was the right things to send or not. I did not get a RFE, so all was good for me.

Contents sent with myI-129f (these were all copies)

about 5 pictures

airline boarding passes

my passport pages

both of our birth certificates

G-325A for both of us (4pgs)

I-134

a couple of my paystubs

proof that I own a home and what I have left to pay on it

a couple passport pics of both of us

I believe that was it. We did not include the letter of intent to marry. We plan to bring it to the interview. For the interview we will be providing a lot more information. Emails, chats, phone records, letter of intent, tax info, cell phone bills, copies of everything sent with petition, letter from bank, letter from my job. Thats about all I can remember right now.

But you have gotten a lot of good info from everyone else, as what to provide. I wish you lots of luck and relax. Follow your 3 steps :)

Yes, relax. Advice is advice. The PI, like the PRC is a high fraud country. Proving you sent money to your fiance doesn't help you prove the bona fides of your relationship and it can cause a Consular Officer to look more closely at the relationship to make sure your fiance isn't just scamming you for money and a green card. Your reasons for sending money are just fine. They are the same as mine were, but there is no need to raise issues that can hurt and are not needed. Proving bona fides is done with evidence of a two-way relationship. Evidence you sent money evidences nothing about her, just you.

Saving these records and having them available for any potential overcome is a good idea but even then, I would only include them if specifically asked for.

I'm not sure who you are asking about the guide. I think it is a good one. Notice it doesn't mention sending evidence of money transfers.

after i thought about it you're exactly right. no need to give anyone a reason to make it harder on us. i'm still going to send everything else, just no western union info. basically because i already have it printed. i got the letter for my fiance w/ her G-325A, passport photo, & letter of intent. but, i was'nt home so, i gotta go pick it up tommorrow at the post office. so, after i get it. i just have to organize everything & mail it. Pushbrk you helped a lot-you answered a ? i had about the G-325A the other day as well. people like yourself, & timsdaisy should get some kinda medal. it's great that you guys can give good advice & calm people down when we're stressin so much.

i'll be posting a timelime soon. thanks again!
