MNSURE, from what I can tell all falls under the same thing. It operates both Medicaid and the state exchange. But MNSURE seems to be the exchange. Check this page. https://www.mnsure.org/new-customers/whatis-mnsure/index.jsp Hopefully there is clarification here.

Thank you @yuna628! I was going to delve some more into the details and read about the policies.....but I think we need more information about the Petitioner (age, income, dependents, employment, wages)....

Otherwise....I think we are “flying blind” on this one......

Correct. You have no current way of proving your immigrant status to them so they can't add you. State exchange and federal exchange programs work a little differently than private insurance companies that don't much care about proving your status, so long as you answer basic questions and pay the premium. Here is MNSURE's guide to immigration stuff. https://www.mnsure.org/assets/MNsure_Citizenship_and_Immigration_Reference_Guide_tcm34-351402.pdf

https://www.mnsure.org/new-customers/who-can-enroll/requirements.jsp

Since they need to know if you are lawfully present in the US or not, you have nothing to provide them to prove it.

this got me,

No, MNsure is Minnesota's health insurance marketplace where individuals and families can shop, compare and choose health insurance coverage that meets their needs.

MNsure is the only place you can apply for financial help to lower the cost of your monthly insurance premium and out-of-pocket costs. Most Minnesotans who enroll through MNsure qualify for financial help. Does this qualifes as Medicaid?

Again it doesn't really matter if you file your AOS before the rule goes into effect.  Her current income needs to be in excess of $21,137 per year for a family of 2 or $26,662 for a family of 3.

Here it says, For coverage years 2014 through 2018, most individuals were required to have health insurance or face a tax penalty, also called the “individual shared responsibility payment” or "individual mandate."  and goes further with "It's important to remember that health insurance provides regular, preventive care for you and your family to stay healthy and prevent illness. Medical bills are the number one cause of bankruptcy and can reach into the millions of dollars. Having quality health coverage gives you peace of mind knowing that if an accident or illness strikes you and your family are protected from a lifetime of financial burden".

Honestly, this is just all crazy!

Hi guys, my wife and I have a little problem and we don’t know how to go about it. I will explain.

i came to the US through K-1, got married on the 5th of July, we have joint account already, applied for state id and already have my ssn. Now the problem is my wife is trying to add me to her insurance, the insurance guys sent us a mail on Wednesday requesting my immigration status( married but haven’t filed AOS yet, forms filled but gathering documents to go with it). Now my question is, regarding the public charge rule, stating do she go ahead and add me to her insurance or not? We filing AOS God willing next week.

Thanks all, your replies and answered are so much  appreciated!

Its effective as of October. You still have time!

It's not a new rule.  It is law that has been on the books for many years, just not being enforced.

Being added to a spouse's insurance is not a public charge issue if she is not receiving assistance

Exactly , Trump is only reinforcing the rule that some were breaking who came here in a spouse of fiancee visa among other visas. We who sponsored our wives and fiancee already knew this rule and so I'm not sure why now it's such a big deal. President Trump just wants those who come here will not become a burden to the US taxpayers.

I think the larger important point for this poster is does the USC spouse have enough to pass the income threshold for the AOS, besides determining what healthcare coverage he can obtain.

She sure does, has enough assets and savings lol. As about the health care. We just gonna skip all that and get the aos filed and get on with it. Thank you so much for your inputs, they are gladly appreciated.
