With a tourist visa she could easily get married in the USA, then return to the Philippines  during the spouse visa process.

 

Whether she can continue to enter the USA using her tourist visa during the IR/CR-1 spouse visa processing is up to CBP upon arrival .. it is possible they would refuse entry.

I am not dual citizen. Im only US citizen.  I was married in civil in the Philippines and now it shows in cenomar that i am married even i am divorce in US already. They wont let me marry until i recognized the divorce out there.  If im US citizen, how can i recognize my divorce in the Phil? Or my ex wife must be the one who must file? What if she doesnt want to file? What can i do to marry my new one?

Did you get a Legal Capacity to Marry affidavit from the embassy?  

 

Like said earlier, you may want to contact an attorney for clarification regarding the recognition of divorce .. there is not a lot of info on this regarding foreigners.

I have not gotten a Legal Capacity yet but i talked to a lawyer out there and said that i have to recognize it first and will take 1-2 yrs process.  

Now, since im still married in the Philippines and if i marry my new lady lets say in The US( coming as a tourist visa) and she will go back to the Philippines after wedding.  Then ill file a spouse visa, will this be an issue in US immigration? Since im still married in the Phil.  Pls advice

I know a guy that will meet you at the airport and perform a ceremony.

You guys can get married anyplace you want EXCEPT the Philippines.

You will have no issues with USCIS or NVC or the embassy in regards to your past marriage being you have your divorce decree.    Only the Philippines will show you as still married to the EX .. and that has ZERO bearing on the visa process.

 

Someday, one can hope, that the Philippines will move out of the stone ages with this divorce issue and kick that recognition of divorce & annulment ####### to the curb.

Exactly, and now I'm a licensed marriage officiant, fly in I'll pick you up at the airport, we ride to the license bureau, I marry you in the car on the way to the clerk's office, we register the marriage license, you buy your copies of you marriage certificate right then and there, I run you back to the airport and you fly out. All done in under 4 hours. Doesn't get any faster than that.

No. This has been stated clearly already. It is clear fraud to enter on a tourist visa with intent to stay. Please see INA 212(a)(7)(a).

I think you're getting info from the rumor mill (there's a few well known facebook groups for Filipinos that spread these myths regarding it being allowed, or a "so-called" 90 day rule).

Using a tourist visa to come to the USA with immigration intent is visa fraud ...  I do not suggest to go down that path.

 

Get married, she goes back to the Philippines and you file the I-130 petition.

The intent to stay and/or file AOS is 100% illegal. The marry and leave advice is legal:

The 90 day thing .. that is mixed up for sure, the 90 days related to the K-1 visa and those people have 90 days to get married after the fiance arrives in the USA with the K-1 visa.

 

Not sure who "others" are but they are a bucket full of mixed up information.
