I-129F Petition denied at interview because of expiry date passed

Timeline

Question from a friend:

He had Interview  (Ghana) and  was denied and the 221g states, because the petition has expired and they will not be extending it and by the time it reaches USCIS they will not be extending it either. No other reason was stated.

 

Interview was made in May for today's Interview date.

 

I have never seen just this reason has anyone else seen this? Also embassy says DO NOT contact them nor NVC. Call USCIS customer service. It's like they are done.

 

My advice to her is DO NOT do another I-129F do a I-130.  Thoughts please

Sounds like reasonable advice to me..........

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

  Sounds like they needed a reason had one handy and used it.  Didn't have to reveal their real thoughts on the relationship.   Better be prepared for a bad interview next around when they will pull out their real reason for this time.

This will not be over quickly. You will not enjoy this.

You have one year to interview but you are approved for 4 months and then you ask for an extension from your embassy.  If granted it will be for another 4 months.  Some embassies ask for new intent to marry letters. Same one you submitted with your I-129f package but update the date and new signatures.  Petition can email theirs to you to print for the interview.

Interesting, as the party line around here has been that the consulate will extend it by request, or even automatically.  Maybe a country-specific practice?  Or another way of utilizing existing rules that haven't previously been commonly used?

Yup, it's specific to the individual case. Most will extend it upon request or automatically. Some tend to be much more strict.

 

Sorry to hear about the case. I wonder if there were other issues (red flags, not much time together, poorly assembled packet, etc.) that just made the CO not want to bother going into any details.

Timeline

The first thing that stands out to me is that the interview was scheduled in the month of May for a date in August. 

 

I understand that some embassies have a long appointment wait time.

 

Was the reason for the long wait related to the embassy, or something else?

 

Our I-129 was approved by USCIS on May 30th and if we could have scheduled an interview for May 31st, we would have.

My petition expire before the interview but I don't know if that gonna be a problem because the embassy give me the date the interview I didn't book it by my mine . Is there any problem with that ?

If the embassy scheduled you interview appointment then you are fine.
