It’s not at all something we all need to become panicky about. People have really become stuck on the 250% positive factor thing because they’ve never heard that number before and it seems to be being interpreted as “oh #### now I have to make 250% of the poverty level instead of 125%.” This is not at all what’s happening here. What DHS has said is that if you have any negative factors weighing against you it can be overcome by making 250% of the poverty level. 

 

What I found repugnant about the PROPOSED rule was the inclusion of minors on Medicaid. Leave the kids the heck out of it. US citizen children should be able to be on Medicaid if needed even if one of their parents is a non citizen who can’t or shouldn’t be on it. They seem to have come to this realization (with a lot of help from an outraged public I’m sure) because they changed this part in the FINAL rule and will not be including minors under 21 and pregnant women.

He knows congress wont pass it.

 

Even If we consider it a merit based system, it would be easier for someone to immigrate AUS or Canada instead of USA.

if you are a family of 4 people to migrate Canada, you need to have 15k in your bank account.

To migrate AUS, you don't even need to prove you are financially fit, all you need is a degree with related experience and good English test score.

 

People love to migrate USA because of the diversity, generosity, family reunification, freedom of speech so on. The most importantly its the only(close to none) western country where you can easily integrated in a society while keep in touch with your won culture.

I never even saw that part in the proposed part of it. If I recall correctly USC children could be on CHIPS without problems for the parents.

Yes, a lack of income/work history/education/etc. will be a negative factor. A suitable I-864 sponsor would still overcome that. A negative factor is very far from a denial...it's one of many criteria considered.

COs have approved many housewives/househusbands in the past, knowing many would would not be likely to support themselves on their own if there was a divorce. That's what the I-864 contract addressed. It will likely be looked at more closely, though.

 

And I get that an intending immigrant in one country may not earn anything near US wages...but the CO will consider what equivalent wages are in the US. Just because an RN in PH only makes a few hundred dollars a month doesn't mean it will be negatively viewed since an RN in the US makes a reasonable salary (although having credential validation, NCLEX passed, etc. might not be a bad idea beforehand!). The CO can consider skills as well as education, work experience, etc.

 

Keep in mind that while there has been a considerable uptick in public charge-based visa refusals in the past fiscal year, there were 236,526 CR+IR approvals alone in FY2018 and 5,518 (not-overcome) public charge refusals across all immigrant visas that same fiscal year.

That's an upper limit of 2.3% refusal rate based on the public charge issue, and it's likely a fraction of that as this ignores family-preference based immigrant visas (There were 533,557 total immigrant visas issued in FY 2018, with the overwhelming majority being categories subject to the public charge inadmissibility).

Table 2 covers EOS and COS applications. K-1 holders are not eligible for EOS or COS.

Table 3 covers AOS applications. That's where they are listed as being subject to it.

Good luck getting a house husband/wife approved if you file after October. 

 

I hope you are right about how this new standard will be implemented because based on my personal experiences the in are going to interpret this in ways most disadvantageous to intending immigrants. 

 

I just don’t see how these new rules will be better at preventing any one from becoming a public charge in the future. Lazy is lazy regardless of the level of education blah blah. I have seen people with masters degrees homeless and people with less than a high school education very successful.

 

Based on the totality of circumstances I see about the changes at the uscis over the last  2.5 years, I believe the USCIS sees itself as the gate keeper keeping out the unwashed hordes trying to overrun America , protecting the American worker from foreign competition et al.

Right, no one is fool enough to migrate to the US if they are so well-off in their countries. Most people move to the US for family reunification or seek for a better life. Some of the wealthy members in this "immigration forum" seem to be very harsh on low-income immigrants and want tougher immigration policies. God bless them!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

BTW you never responded to my last message at all but I was wondering what group you are from, are you Punjabi, Gujarati, Tamil, Telugu, Adivasi, or Marathi?

Answer mine. Were you making 250% above poverty level when you were trying to get your wife approved? Was she educated, fluent in English and not a potential public charge/ Would she have passed through the process with today's laws?

As I said yesterday that yes I was making 500% of the poverty level supervising and managing Indians. She is educated with a Bachelor's, and was ok in English. So answer mine.
