Final public charge rule

Timeline

 

         I just married my beautiful long time girlfriend 2 weeks ago in Romania. I am us citizen with dual citizenship (Romanian) and have been living with her for some time now in romania. I was planning to file the i130  early next year. Since i am not working in the usa and wanted to be with her while we wait for the process, i had to find a co sponsor which i did, now that it seems like everything just got so much harder is a co sponsor even an option?

 

We both have been stressed about the whole process before this new rule came out about  the public charge, now sadly we are on the brink of depression ever since finding out that this process will be 10x harder than before. 

 

I read that this rule takes effect in 60 day, does this mean that i should file the petition right away and before the rule is enforced? or did i hear and understand wrong. I am at a loss for words and i dont even know what to do anymore. 

 

Can anyone with more info on this new rule please tell me the best way to for forward? Should i apply now rather than wait? Also i would like to file from abroad as do not want to leave here just to file from the us. is this even possible now?

File from abroad.  The is notice of a proposed rule that will take effect in 60 days.  This had been pending since last october.   People will sue to change the rule, it can be changed by policy.  There is no benefit to waiting.  There never is.

 

Since you are married you will not be doing a K1 petition.

I work in healthcare and someone undocumented can get emergency Medicaid in my state (for hospitalization) but that’s all- it does not cover outpatient services, medications, doctor visits, etc. they are on their own with those.

 

 

If a US citizen who is disabled or elderly can’t afford to care for themselves why should the US be responsible for caring for the family member that the disabled/elderly person wants to bring in? They don’t have to move here. They choose to. Therefore they should be able to afford costs.


Each state differs on these rules. In some states, you can be illegal and get a drivers license and other benefits.

A drivers license has no correlation. The main reason for undocumented people to get a drivers license is so they can then get car insurance- hence lowering the # of people driving without a license and protecting others bc the undocumented person can carry car insurance. (Hence protecting the other person)

 

my point was people have a misconception that the majority of undocumented people use public benefits when in reality that is NOT the case and many times it’s not possible for them to get benefits.

I feel for everyone who has not applied yet. But, I do think some of us on here are panicking too fast. Nowhere on the proposed rule does it say cosponsors are now no longer allowed. THat was just a suggestion made by a vj user, not immigration. None of us are sure exactly what will come of all this/what will be shut down/what will go through, but as others said, there is no benefit in applying later. So apply as soon as possible, even for just the sake of it getting approved sooner.

I've dug around a little. The 250% seems to just be a favorable factor, not the actual income requirements. You can still file your petition of support as long as you or your co-sponsor makes 125%. 

 

This seems to be focusing more on not using public benefits as opposed to lower/working class incomes. 

Don't panic just yet, California and Connecticut are suing.

Oh yeah there's nothing about cosponsors.

It is possible that peoples cases may have extra annoying steps such as the I-944 but that's about it.

I'm honestly not sure, it's all still so new. I believe if they sue the administration it could tie everything up in court, but that's about as much as I know. I'm sorry. It's still so brand new theres probably a lot that they have to work out still.

I read it and a figure of 250% is mentioned - of the poverty level. Which is less than I read about previous, but again, they talk of the 'Totality of circumstances'.

The 250+% threshold is to be considered as a heavily-weighted positive factor. The 125% level remains the same.

Totality of circumstances has been around for decades.
