Is it possible to change jobs while green card is expired?

Hi,

I need you help. I'm going crazy...

My conditional green card is expired since March and the new one hasn't reached yet. (No even approved yet, still pending) >> Vermont.

I would like to change jobs but I have found out that the expired green card is not valid as proof for the form I-9 (employment verification). I-9 is the form that all the companies request to all the employees to verify that they are legally authorized to work in the USA. I have read that although an expired green card is valid to continue working under the same employer, an expired one is not enough to prove employment

Do you guys know anything about this? Thank you.

Technically, being expired, it's also not valid to continue working. The company may not be keeping track of your status, but if they did, you could have issues. You'd be best advised to get it sorted out quickly (and before changing jobs).

I'd follow some of the above-posted advise. :thumbs:

No, I did not get it and I think I see the importance of getting it now. I judt didn't know that the SSN card without the restriction is a valid proof for the I-9. I found out by chance this issue with the I-9 form.

I thought the extension letter (I-751 receipt) was enough to work but now I'm not that sure.

Yeah.. a DL and a Unrestricted SS Card is enough for the I-9. The employer has absolutely no right to ask you about your PR status or for your PR card if you have the DL and Unrestricted SS Card. If they give you a problem, you can get the Department of Justice to give them a call to set them straight... I'm sure they would love it.

You can still get it... go to yourlocal SS Office and with the Expired GC and the extension letter, you will be able to get an unrestricted SS Card.

Yes...

Regardless, the extension NOA from the SC states that your PR Status is extended for one year and is valid for travel and employment purposes.

I just came from the SSA office. The extension letter is good for nothing. Their policy says they don't accept letters, only stamps in passports.

I also got my infopass appoinment for tomorrow morning. Let's see if they give me the stamp...

There have been discussion in the past about this matter.

It may help to take a look.

To sum up, updating a SS card to one without a legend is not allowed when the green card is going to expire in 2 wks or less.

Getting a new job with an expired green card + extension letter (NOA) could be tricky but is not impossible with contacting right places--e.g. justice dept.

Continuing a job after the green card expires is fine as long as you submit the NOA to HR because it states that the status is extended for a year.

I would like to know if the stamp on the passport will work.

I heard that the stamp is not issued any more but in this case it may be the only way...

That would be good news since it is simpler than calling justice dept.

I got the stamp in my passport this morning. Valid for a year starting from today (which I'm not sure if it makes sense given that the extension letter is only good for 6 months more...!!!! I filed in December 07). The lady officer mentioned that we are entitled to that stamp and she didn't say nothing when I told her the SS Admin does not consider the letter as a proof of legally residence, which it makes me wonder. She has also told me this morning that if the SS admin. undertands the different categories of statuses (we fall under CF1 conditional), it would not give me a replacement of the SS card without restrictions. In her opinion, neither they should give a new card nor a new one without restrictions.

I'll go to visit my friends at the SS office this afternoon when my boss is not looking to see if they can do something with the stamp.

We had the same thing happen with us. When my husband went to the SS office in NJ for the unstamped SS card they said the letter was not good enough...that we needed the stamp also. We haven't gotten that far yet. So...did they tell you that even with the stamp they won't reissue the SS card? That doesn't seem right.

Good luck with the SS office. I would be insistent with them. My husband got his updated 20 days before his greencard was expiring. They were trying to tell him that it had to be 14 business days before. But they couldn't find where it said that anywhere, my husband was saying it's just 14 days. But they had no proof and my husband had the paper work/instructions printed out from their own website. So in the end he got his.

I do not remember seeing anything about the passport stamp on the SS webpage, but that should work vs. just having the letter.
