Yeah there was someone just in July who got I-130 approved after sending I-129f in June and their I-130 was sent February 2019

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Why waiting to the end of September to consider filing I-129F instead of trying now ?

Thanks for your opinion. You right. I will apply this week and I will travel to my country next month.

Yes the fee for I-129 is $535 but if you already applied I-130 it's no fee for the spouse. In the form have option ask you for spouse or fiancé.

Long time lurking, first time posting 😉 First off, congrats to everyone who is getting their approvals!  PD for me is Oct 5 2018 . It's been a lengthy, stressful, 312 day journey so far.

 

We used an attorney for the I-130 but that was because I didn't know about this site at the time. The attorney is/was a disaster. Will not do anything to help. Bad advice from the start. Multiple mistakes on our original forms that luckily I caught before they sent them in. Total waste of money. Had to research most stuff myself. Planning on doing the next stage on my own thanks to the wonderful help on here.

 

 I am seeing everyone who is successfully getting action by going I-129 route and am seriously considering this. Same issues as everyone else on here; missing my husband, not being able to plan our life, son's schooling will be messed up due to two different systems and not knowing when he will be down there, trying to maintain two households and running out of money etc. Reached out to our senator  (as lawyer refused to help) but they are getting same run around answers. "I-130 is a 13 month lead time" speech is what came back today. I was hesitating thinking it wasn't going to save time but some of the posts I have seen are approvals in 1-2 months. My biggest concern is if they actually approve the I-129 and not my I-130.

 

My questions:

  • Has anyone on this forum had their I-129 approved instead of the I-130 or faced problems because they filed for the I-129?
  • Has anyone on this forum filed the I-129 on their own even though they used a lawyer for I-130? Did it cause any issues?

My husband is nervous about us sending in the I-129. Being allowed to move to be with him is great but if I am not able to work and my son can't go to school as we have no authorization it will be a problem.

 

Just wondering if anyone on here experienced anything negative going this route?

Not that I know of that someone i129 gotten approved. And I filed the i129 on my own & I used rapid visa . Now I regret using them because you can do all this on your own. But I did file the i129 alone & I think I’m going to finish the rest on my own . Hope this helps

I think we all need to be mindful that doing dual processing eg I130 and k3 is a trend that could backfire... the more people file the more administrative pressure placed on USCIS the slower all processing becomes.. just saying

If you do plan on sending the i-129f you'll likely get denied as in that there won't be a k-3 visa issued. It's super rare but like the lottery. There's a chance. 

 

 

You can choose not to have the lawyer involved any further. My observation has always been that immigration lawyers that have no trial experience are rubbish. Otherwise they are form fillers. 

 

You're near the end of the journey. You can file it's free but postage But so late in the journey I wouldn't be surprised that you'll get an approval before the i129f is even looked at and either way the end result will be the same. The petition will be denied and since the i130 was approved. 

 

So you got nothing to lose for those that had success. I was skeptical and I see there's action but I didn't have to do it myself, but most people wouldn't do what I did and if my efforts had any effects then I'm not sure which one tipped me over the edge. (See my timeline for more details) 

 

I'm a proponent that has US Citizens we shouldn't have to put up with an inefficient system and protesting in any way possible (within the law) is the way for change. So I did things most would fear since they think that the govt employee might toss their petition at the bottom of the pile. 

 

Do everything you can to be with your love one. 

 

As I tell my wife. I'll make every effort to make things happen. 

 

She and her family was expecting Sprint/summer of 2020 with the delays and she can't believe it still now she understands why I didn't want her to work and to spend time with her family. Working for her would have meant leaving the province and away from her family to continue the field of work she's in. 

 

I'm still furious with the USCIS Nebraska SC. The leadership should all be terminated in my opinion there's no reason for the mismanagement.
