There is nothing definite about any of it... and they could still end up having to wait in line like everyone else..

hope on the pot luck chance of K3 approval that your all prepared to move and then wait out until the I130 is approved..

Nothing in life is guaranteed, but thanks for your feedback.

I don’t See the problem with this.. he’s not trying to reinvent the wheel or anything and heaps of other countries have exactly the same rules... it’s a fair rule... you want to go live somewhere you gotta be able to stand on your own two feet and support yourself both in the short and long term..

Thanks for your opinion.

Not once yet seen an I129f be denied without an I130 approval. If they were just going to leave the I130 and not process it then they wouldn't have denied the I129f because there would be no basis to deny it on. If anything it would have been approved if there was no I130 approval yet, so that they could come to the US to wait for I130 approval. However, it was denied, and the consistent, sole reason so far of I129f denial, is "your immigrant visa petition has been approved and your spouse no longer requires the issuance of a K3 visa to await adjudication".

Our CR1 Journey:

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

Oh boy.. Sorry to hear my friend

I hope you will get that case number as soon ☘️

Today someone picked pocketed my bag.. And my oneplus 6 mobile got stolen. Argh

That had my photos with my spouse.

I think the public charge rule applies to those who file their petition before October 15 2019

And this is still the case...at least for me.

Received notice through the mygov website that the case was approved Oct 2nd.

So, for those keeping track, there are two websites -  my-gov and e-gov...I got I-129F denial through e-gov, but no notice of approval there. And I got approval of I-130 notice through my-gov but nothing on the I-129F denial there.

So, have an account on both I guess is the best thing to do...
