Hey, really new in this forum! Thank you all for sharing your experience. My wife already sent I-130 and now we will apply for K3 in order to speed up this process as you guys did!

While filling out the form I-129F, we found a conflict here: "If your beneficiary is currently in the United States, complete Item Numbers 38.a. - 38.h." but in instructions for this form says:  "Item Numbers 37. - 38.h. Form I-94 Arrival-Departure Record. Select the box to indicate whether your beneficiary has ever been in the United States. Provide the date of your beneficiary’s most recent entry in the United States, his or her I-94 Arrival-Departure Record Number, if available, and his or her immigration status at the time of arrival (for example, student, tourist, temporary worker, without inspection). Provide the expiration date and identification numbers on the I-94 or I-95 Arrival-Departure Records, travel documents, and or passports. See the What Evidence Should You Submit section of these Instructions for additional information. If your beneficiary was admitted to the United States by CBP at an airport or seaport after April 30, 2013, he or she may have been issued an electronic Form I-94 by CBP, instead of a paper Form I-94. You may visit the CBP website at www.cbp.gov/i94 to obtain a paper version of an electronic Form I-94."

What should I do? I have been in the US using my B1/B2 visa (last week in fact was my last visit to her town) but I am NOT currently living in the US; I live in Mexico. Form itself says I do not need to complete item 37-38h but instructions says I should provide that information for my most recent entry.

For you guys that already sent 1-129F and were in the same case, would you mind giving me your comments/experience/what did you write here?

Thank you all!

Check "Yes" on Item 37 "has your beneficiary ever been in the United States", and then ignore Item 38a-38h as those ones are "if your beneficiary is currently in the United States" on the form (so that part is not needed). Just check yes, ignore the rest, and done with that part

I didn't file the i-129f, but I did get a record of my wife's entry and departures from her J-1 visas, and tossed it on the pile of evidence for my I-130.

Anyways just request the I-94 it's instant and provide the info.

01/28/2019 - Mailed Express Mail USCIS Lockbox Phoenix

01/29/2019 - Received by Phoenix Lockbox

I wouldn’t as it’s for “if the beneficiary is currently in the US” and could be misleading if filled out, I left that portion completely blank on my I129f

38a-38h isn't required since you're not in the US so don't even worry about it, we didn't fill that part out we just checked "yes" for "ever been in the US" and skipped 38a-38h and we were approved with our I130 and denied with our I129f yesterday with no problems

Congratulations

Thank you! And yes! Our I130 is not showing approved online either still, I would call USCIS and check on the I130, likelihood is that it was approved the same day that the I129f was denied like ours was
