You have to file AOS.  But unlike a K1 it is multiple entry for two years and can be extended.

Question for you all. We are in the processes of a CR1 visa. In my i130 application I put my spouses new last name even though her french passport has her old last name. We have a US marriage certificate that shows the linkage between her old last name to her new one. It is taking quite sometime to get her French passport Updated to her last name.

Would we have any issues at NVC with her passport showing her old maiden name?

 

The marriage certificate shows the linkage so I’m not sure how they will handle it.

This is how we did it too. My plan is to have my passport changed to reflect my married name once the I-130 is approved. This way, copy of passport to be submitted to the NVC will match the name appearing on the I-130

Feel like my case will never get approved or will take the entire 16 months to get approved since they moved on to March already And forgot about us. seems to be very unfair ignoring January petitions while people who filed 2 months later are getting their approvals faster.

Feb 14 2019: Send I-130(a)
Feb 19 2019: Delivered

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

Oct 2 2019: Send I-129F

Oct 7th 2019: Delivered

Oct: 11th 2019: Received NOA1

March 30th 2020: I-130 Approved 

April 13th 2020: Case received by the NVC

May 1st 2020: NVC Welcome email received

May 1st 2020: Paid Bills, processed on May 5th 2020

May 15th 2020: First initial submission

May 26th 2020: Final submission

June 1st 2020: DQ NVC

Waiting for interview letter..
