All Nebraska I-130 Filers -- Part 5

Checking in. I'm filing I-130 & I-129f for my wife. I'll add the info my signature later but here's the timeline:

 

I-130 Submitted Nov 6, 2019, NOA1: Nov 12

I-129F Submitted Dec 16, 2019, NOA1: not received yet but called USCIS and got the receipt number and added case to USCIS account, it's also being processed in Nebraska

 

I also had tried an expedite request for humanitarian reasons (civil unrest here in Chile) and it was denied within an hour or so. I'm thinking that the USCIS usually denies expedite requests by default. I'm currently in touch with my Congresswoman trying to get her to help us out with an expedite request.

 

Supposedly the I-129F visa should be adjudicated about 6 months quicker than the I-130 but we're still talking about 9 more months once all's said and done, such a slow process. I'm really hoping to be able to get an expedite request approved.

I wouldn't count on the I-129f helping, especially in Nebraska. Our I-130 has been in Nebraska for over 7 months and our I-129f has been there since Oct. 14th and nothing. I think they realized what people were doing so they will more than likely adjudicate them both together. The processing time is between 12- 16 months I believe, unless they really start working on them. Good luck and hang in there, it's a ling process.

Thanks Patricia. I know... I looked up the statistics for K-3 visas. In 2018 only 6 (six!) were approved. I realize that it's a long shot to say the least.

 

On the other hand it seems like you applied for the I-129f a long time after applying for I-130 whereas I've done it within a month of getting NOA1 for I-130. From the USCIS website it says that it should take between 7-5 & 9.5 months to get the I-129F approved, quite a bit shorter than I-130 (12.5-16 months). I think if the date for adjudicating I-129f is within a few months of adjudicating I-130 they just deny it.

 

As far as the expedite request being approved it seems like humanitarian reasons is a very tough reason, but we'll see if my Representative can help.

USCIS Stage:

  • Nov 12 2019: NOA1 (NSC)
  • Dec 17 2019: I-129f Received
  • May 15 2020: I-130 Approved!

NVC Stage:

  • May 16 2020: Case Created
  • May 16 2020: Fees Paid
  • May 22 2020: Sent IV & AOS Packages
  • May 29 2020: Request for more documents (proof of assets)
  • May 30 2020: Resubmitted NVC documents
  • June 15, 2020: DQ'd!

Yes I did file the I-129f a while after the 130. Th I-129f will most likely be denied as with most people that filed it no matter how soon or how far after the 130. Of course there is still hope so I wish you the best. There are others that filed months after the 130 and they are still waiting as am I. Good luck!

Nebraska takes the longest to process petitions it seems.

Generally speaking humanitarian reasons would only apply to places of mass disaster and famine or declared war zones that are acknowledged by the UN....

 

Civil unrest, gang violence, poor policing and other risks due to poor governance by a countries leadership dosent fall into these categories (or the influx would be millions, it’s up to the poeple to replace their countries leadership, not america to take all their people).. 

 

other than that they look at how the expedite affects the partitioner not so much the beneficiary

Interesting info, I seem to remember reading that civil unrest was a criteria of expedite but can't seem to find the article on USCIS's website.

 

I disagree with what you say about an influx of millions. We're talking about expediting my I-130 petition for my wife of over 5 years and not a blanket asylum benefit for all those in unsafe conditions. Very different situations. I'd argue that the expedite request does benefit me the petitioner since I currently live in Chile with my family and won't move back to the states without my wife and daughter. I guess you could argue that I can just leave my wife here and move back to the states with my daughter (she's an american citizen by birth) but that's a pretty crappy situation.

Unfortunately, if they make one exception to the rule they must make all exceptions to the rule.. they can’t discriminate.. so if they do it for you, they must do it for all and there are millions trying and waiting in line that could use civil unrest as a reason.. and yes as a USC, you can move home at any time you wish, if you choose to stay it’s your choice.. the US is only responsible for you and your child (if registered usc) not your spouse at this stage.. sorry, but it is the way it is..

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

Oct 2 2019: Send I-129F

Oct 7th 2019: Delivered

Oct: 11th 2019: Received NOA1

March 30th 2020: I-130 Approved 

April 13th 2020: Case received by the NVC

May 1st 2020: NVC Welcome email received

May 1st 2020: Paid Bills, processed on May 5th 2020

May 15th 2020: First initial submission

May 26th 2020: Final submission

June 1st 2020: DQ NVC

Waiting for interview letter..

Don't  I wish! When they say Nebraska processing time is 16 months, is that just for approval? This is crazy. I am happy for the ones that the I-129f helped ,it just sucks for the rest of us. Seems kind of unfair, but what can we do. I don't believe they are processing in the order they recieve petitions like they say,  Now over 7 months and still waiting. I wish everyone the best of luck. Especially those stuck with Nebraska service center.

For most people they are taking around 12 months for the approval of the I-130 without the I-129f. That is, a few days before or after your one year since you sent the petition. It is unfair, same with NVC later, but oh well, it’s just part of the process. Just focus on your case and make sure to have all your documents ready for NVC, and triple check everything before submitting so you don’t need to resubmit or submit a missing document :)

The USCIS processing times website says 12.5 - 16 months for Nebraska, but the 16 months (max) is 130% of what it takes for 95% of the applications (according to USCIS Website).

So the average is 12 months.

AOS fee finally marked as payed: 06/10/2020 🥳

I filed the I-129f in Oct. They have had it for 84 days now with no denial. I am not sure on the docs needed for NVC. Any info you can give is appreciated.

Oh I’m surprised you still haven’t heard anything.  Hopefully you hear something soon. Here you can start seeing all the steps for NVC and what documents are needed. Also read their tips :) good luck!
