They asked us three expected questions about our trip, two of which I answered, then we were asked if we were planning to apply for an immigration visa for my wife and I told the officer that we were in-process and recently had our I-130 approved. The officer didn't even look at my wife's ESTA (said she didn't need to see it). Smiled, told us to have a good day, and waved us through. I was expecting my wife to be pulled out of line and questioned without me for an hour or so! I hope all the other holiday travelers here have the same smooth experience entering the US.

It's very easy to get in with an ESTA, I am currently nearing the end of my 2.5 month stay, got asked three questions and got a cautionary "Don't overstay" from the CBP officer, and I was off.

Glad to hear it was a simple process for you, too. We had a Japanese friend who'd gotten pulled aside at Immigration and questioned for an hour. Had an ESTA and also had lived in the US for many years before. Anyway, all's well that ends well!

Processing times on USCIS website is up to 16 months now for I-130. Their timelines are bogus at best.

According to some statistics I gathered, they're now processing cases in January 2019. So, I expect a quick turnaround for backlogged cases in December 2018 (most of which has already been processed a while back), at least once holidays are over.

I have been waiting for the past 8th now and my Visa journey estimated time is saying April and when I did my little research I found out that my Priority Date will be open by January 31 . Please with this can you suggest when I should be expecting my approval. Thanks

The priority date is the date of your I-130 receipt. Does that mean your PD is in April?

 

On another note:

Good news to everyone with PD between Dec 31 to Jan 28 on their I-130. There was a mass update today on a lot of cases within that period. If this applies to you, check your case statuses and emails for updates.

Although the next period will be a bit slow as we go into U.S. holidays, I expect further (and quicker) updates within the coming weeks.

Luckily our consulate has no wait time so while the extra wait for that small 2 sentence document sucks at least we should have an interview letter almost immediately.   • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020

Sounds more of a routine than a requirement. You're almost there guys, wonderful!

It also sounds to me like you have a co-sponsor. I'd love to know more about the details of the paperwork you guys filed with NVC thus far, if you don't mind.

When I called and they told me I needed to upload that, I looked at every travel.state resource I could find and found nothing on it. Which sucks! If it had said anywhere we could have avoided it but oh well, just got to wait it out now, I just hope it doesn't take another 5 weeks!

 

Yes we have a joint sponsor. For myself for AOS, we uploaded the I864, my 2018 1040, my 2018 W2s, my birth certificate, my marriage certificate, and last week the requested unemployment letter.

 

For our joint sponsor (my parents) we uploaded my stepdad's I864, his birth certificate, his drivers license (for the domicile requirement), his 2018 1040 (joint return with my mother), his 2018 W2s, and his 3 most recent paystubs.

For my mom (his household member), the I864a, their marriage certificate (for proof of relationship), my mom's birth cert, her drivers license, her W2s, 3 most recent paystubs, and we included their joint tax return under her documents as well just to be safe.

 

Then for civil docs for my husband, a scan of just his passport bio page (was worried they would think it was too blurry but they accepted it), a 2x2 US passport-style photo (we just used an app on my phone and used flash to get rid of the shadow!), his birth cert, our marriage cert, and his police cert. He was able to order all of his civil docs with English already on them so we didn't have to translate anything. Everything was accepted, it was just that dang unemployment letter! a Bit of a bummer thinking about how he could have been having his interview in a few weeks had we not had to upload that, but we'll just have to push through. How's your process coming along?

Take a look at this post, and you'll see you were not the only one facing this. Technically speaking, I think it'd be referred to as a "statement" instead of a "letter".

Didn't you file an I-864 for yourself where you stated you're unemployed? I'm almost sure you did.

 

At this stage, I wouldn't worry much about anything, it's just paperwork. Even if there's an issue with any of your docs (such as typos or bio info), you'll get the chance to correct it at the interview.

Also, what app did you use to take the photo?

No updates thus far at all on my end. Hopefully, soon.

Thanks for sharing that! Ugh wish I knew sooner. Yes, I put that I'm unemployed on my I864 so it makes no sense to me on why they need a statement about it, but it is what it is. I called them because it said "Upload proof of [my] current employment", and obviously I have none, so I called and that's what they told me to do and to put it under "proof of current employment" category, so now I'm just hoping it doesn't take too long and that they review our docs again soon!

We just used an app called "Passport photo - ID photo" on the iOS app store, but I'm sure pretty much any passport photo app will do as long as it's got a guide to show you where to have the head at! We just had my husband stand against our white wall, and used the flash on my phone to make sure that there was no shadow, and then uploaded it and they accepted it which I'm glad about! I hope you hear about your case soon 🤞
