I 130 PD December 10, 2018

I 129F PD July 8, 2019

September 9 - Expedite request of I130 via mail (Status of the expedite request: Transferred for review by an officer)

October 5 - Expedite request of I129 by phone

October 7 - Expedite request of I129F denied (no one asked for any evidence. Just denied)

November 5 - Contacted congressman asking for assistance since I130 expedite request was taking way too long. Congressman contacted Nebraska Service Center.

November 8 - Status of both I130 and I129F changed back to "Transferred for review by an officer" and the countdown started from 0 (as if they just received our evidence)

November 21 - no changes to the case(s)

Going off trend.... your i130 would be getting close to adjudication this December without the I129f and expedites...

did they say why expedite denied?

You do realise USCIS are not obligated to respond at all or give justification for its denial? Timeframes for processing of expedites are on a case by case bases... what you and they consider as too long can be two entirely different things unfortunately

I don't think the VJ community has seen any i-130 IOE receipt holders "helped" by the 129f...

I don't have an IOE number. I have LIN #

What service center was your petition at?  How long did they have your petition, because Nebraska has had our I-130 almost 6 months now and our I-129f for 38 days and nothing? It's so frustrating and it does put a strain on relationships.

Nebraska unfortunately.  It seems they are only expediting I-129F if your I-130 starts with LIN#

Yes it depends on the embassy. There might be interview discussion for Iraq here on the middle east forum:

https://www.visajourney.com/forums/forum/97-middle-east-and-north-africa/

Or you can check others from Iraq's timeline. Coming from Iraq though, be prepared for a long time in AP after the interview. Long AP for MENA countries is common and expected sadly

Our CR1 Journey:

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

October 11 2020: Arrived in US!

Amen 🙏

Your spouse should walk into that room with purpose come December 11.

Like I mentioned earlier, confidence is key.

You can't be talking about the love of life with a long face or shaky voice.

Sends the wrong message.

All will go well.

When you put your cares into God's hands, He'll put His peace into your heart.

🙏🏿

I hope you dodnt mean to sound condescending because it sort of felt like you did.

USCIS is paid by all of us and they should definitely have more obligations if you ask me. And yes I feel like they cant just deny without asking for anything ar all. You saw my other update - they changed the status back to "transferred for review". And yes they themselves say to reach out to them if after an expedite request petitioner hasn't heard back within 14 days. I see other people hearing back withing that time frame but not us. And why do you think I should be ok with it or not wonder why they dont follow their own standards? Expedite requests mean there is an urgency. And if they dont even look at it and not treat applicants like people then that is BS plain and simple

NOA1 for I130 - Dec 10th, 2018

Filed for K3 July 8, 2019.

Expedited I130 September 8, 2019 still pending review

Expedited I129F September 28, 2019.

I129F expedite request was denied on October 1st, 2018. No change since. Still pending approval/denial

No I don’t mean to sound condescending at all, I’m just referring you back to USCIS policy...

unfortunately yours, my or anyone else’s feelings about their said policy for expedite or your expectations dosent change the fact that their policy does not require them to respond to your request at all or for them to provide justification behind their decision to deny your request...

when it comes to paying for the service, I’m paying too, should I not be placed before you in line?

whilst sympathetic to your situation,  I can assure you you’re not alone, and unless you can convince them that you fall within the criteria for expedite request and prove said criteria then chances are you’ll be denied (within their timeframe, not yours) and not be given justification for it...

Well they did not deny our I130 expedite request. They sent it for review. Back in September 8!!! And it has been pending that review ever since which is beyond ridiculous
