we are living together overseas and filed for the I-129f over a month ago. Since we want the result to be denied for the I-129f and an approval for the I-130 it should be fine :)

Feb 14 2019: Send I-130(a)
Feb 19 2019: Delivered

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

Oct 2 2019: Send I-129F

Oct 7th 2019: Delivered

Oct: 11th 2019: Received NOA1

March 30th 2020: I-130 Approved 

April 13th 2020: Case received by the NVC

May 1st 2020: NVC Welcome email received

May 1st 2020: Paid Bills, processed on May 5th 2020

May 15th 2020: First initial submission

May 26th 2020: Final submission

June 1st 2020: DQ NVC

Waiting for interview letter..

There is not an estimate. It all depends on the following:

- when the nvc received your case;

- how fast you finish the nvc process (uploading docs, paying fees)

- how fast you can schedule your medical and interview (country based)

Thanks for responding. Okay. Seems like a good 3-6 months in estimation

It seems like if you don’t have an IOE receipt it’s still speeding things up. So anyone at Nebraska prior to July could still have luck with it. I’ve not seen anyone with an IOE receipt that has filed a I-129f get any progress yet (is included)

So is it an advantage to have IOE number? I do not think there is a big difference.

Doesn’t appear to be as yet. The ones who did have it earlier this year as part of the pilot programme got fast approval but are all stuck at NVC 🤷🏼‍♀️

Once they start on end of June / July filers we will see if it’s a difference

What I think is happening with the I-129f:

The K-3 visa is still a viable product and has not been eliminated on the UCSIS website.  The stated purpose of the K-3 is "Historically, you and your family members might have been separated for some time while waiting for a decision on your Form I-130. Congress sought to resolve this problem by creating K-3 and K-4 nonimmigrant visas to shorten the time your family would need to spend apart."  So, when they receive a I-129f petition, they have 2 choices.  One, they can process the I-129f petition and issue the K-3 visa.  But if they do this they are effectively doubling their workload because at some point they will look at the same case with the same 2 people and process the I-130.  They certainly can't afford to double their workload.  The other choice is to deny the I-129f and immediately process the I-130.  They can't just slap the I-129f onto the I-130 and let both of them languish until the processing time of the I-130, because that would be violating their own stated purpose of the K-3 visa.  If they deny the I-129f, they must have a viable reason, and that reason is the I-130 is being processed.  I suspect they have an internal standing order to proceed this way when they receive a K-3 application.

 

Those who file the I-129f are jumping ahead of those who don't.  But USCIS created this situation with their year-long wait times.  I expect them to eliminate the K-3 or change rules at some point, but until they do it is beneficial to file the I-129f.

Trying to make sure I understand your comment.  My I-130 was received on 9/10/19 with IOE number and my I-129F was received on 9/27/19 with LIN number.  Does that mean the I-129F trick will not help me since I have an IOE number?  Also, anyone else here been approved who submitted I-129F around my date?

Yes.... That’s what it seems like. No one that has received an IOE receipt number since it became common and that has also filed for the k3 has had any movement on either of their cases (that I’ve seen on here or on fb groups) our PD for I-130 is 07/09/19 and our date for I-129f is 08/16/19 and we’ve had no updates on either

No physical letter yet! 

Wondering how much this is going to set me back!?

What is the difference from IOE and those that are getting their I-129F approved?
