Timeline

I filed for the K3 and I believe it helped. The I-129F was rejected because the I-130 was approved and my wife was no longer eleganle for the K3. (Although the I was notifed of the I-129F denial first). 

 

Just by that thread, the I-129F forces a decision on the I-130. In that member's case the decision was to deny. 

 

With everything there is a risk. It's free to file the I-129F after the I-130. So if anyone feels it will them they should do it.

a Short Time Later after talking with Rep. Case's office, they contacted the embassies again. 

Response 3: Feb. 21, 2020 - Transfer complete; New interview scheduled.

 

Interview Date: Mar. 2, 2020 - Tokyo Embassy

Visa Issued: Mar. 4, 2020, Visa in hand: Mar. 6, 2020

Time: ~359 Days from start to finish 

POE:  Stupid COVID-19 delaying travel to the US....Aug. 13, 2020 - San Francisco 

GC: Aug 5, 2021 (51 weeks from entry)

yes it is still nothing, if you look at het dates you can see she submitted it wrong. People in that specific thread calling her out on it too, it is very sad to read.

 

she filed for the 130 and the 129 one day after each other, without waiting for to NOA1 from the 130 (that you need to file for the 129).  So they can ask for rfe.

overall I can not conclude that if she would have filed both in the right way the K3 slowed doen het process, but the bad timing is.

 

Yeah I agree. They most likely made a mistake at the beginning and is probably a one-off. I think filing helped me and will help others.

Processing times are available online. https://egov.uscis.gov/processing-times/

 

Just checked. Processing times slipped down. They were 12.5 to 16 months last week. They are 12 to 15.5 Months right now. You can inquire about your case if your PD is before August 01, 2018.

I don't think the I129F forces a decision. Unlike when someone uses the writ of Mandamus, USCIS is not obligated to produce a decision on your I130 when you file a K3 within a specific time. You could probably do a case inquiry on the K3 earlier if you filed them concurrently. However, that'd be 9.5 months (today's max processing time for K3 at Nebraska) from the PD of your I129F.

 

It's probably just an unofficial policy in Nebraska to start looking at an IR1\CR1 case right away if the I129F is filed. They still take whatever time is necessary to do their due diligence on the case. My case took around 30 days since my K3 application. Another user's case took 45 days. They spend whatever time is necessary. I do not think the I129F pressurizes them to produce a decision within a limited time frame. They could sit on my K3 for 9.5 months without me being able to file even a case inquiry.

 

The case that got denied probably would have been denied even if it got looked at an year from now. The I129F just made them look at the case earlier.

me and my wife we fill the i130 on august and we get our NOA1 i130 on the 15 august nebraka centre and our receipt number started with IOE and yesterday we send our form i129f for k3 to see if we can get approved quick by this and i hope some one can gave me good news about what we did
