We've filed on October 29th, I'm just now hearing about this I129 form being filed to expedite the I130. I still have not heard anything as of yet, we have received the NOA1 back in November Of last year, but nothing else. My question in filling this form will I have to submit all our documents again or are we sending in the form??? I'm really pissed this has dragged on for so long, being that others are getting theirs approved way before us after filing way after. Not truly understanding any of this and I'm about to blow a casket because to me this is one foolish, unpleasantness that I'm feeling in regards to this process....

With I129f no evidence of bona fide marriage is required. All that we sent with I129f was photocopies of marriage certificate, US citizen’s birth certificate, NOA1 of I130, and 1 passport photo of petitioner and 1 of beneficiary

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Well this I129f is not meant to expedite the process, so you wouldn't have heard about it other than in this thread.. I asked a lawyer about it and they told me there is nothing I can do to expedite my case and that currently I130s take a year to get approved. My lawyer also said there is no harm in filing a K3, but that they take about 9 months to process. I went ahead and did it anyways and it worked (the I129f was processed in ~1 month and 10 days). So I am truly thankful to the people who shared in the forum (plus I lost my faith in lawyers who should be aware of loop holes in the timelines)... I think since you are getting into one year margin, you should be expecting the approval soon, but since there is no fee in the I129f (if you have already filed a I130), maybe there is no harm I guess in submitting one....?

My lawyer did the same thing, he told me to wait at least 2 years. If i knew better I would went ahead and join VJ long time ago. Until this day Im still regreting not finding out about VJ sooner

No K3 denial yet, however, I'm not too concerned.

Hope you got yours by now, but i submitted my I-129 on 10/5. It arrived 10/8. NOA was received both 10/14 and a letter in the mail a week later.

I haven't received any mail notice so far; but when I called them they gave me my Receipt Number and asked me to wait till Nov 1st week before requesting a copy.

I called today and had to take it a step higher for more information. Had an Officer call me back to state that my file has been place in an officers hand to review🙋🏾‍♀️ So I’m excited for that information. I’m just ready to move on past this step..😳Wishing everyone the very best🤗🤗🤗🤗 thank you all for the support 💃🏾💃🏾💃🏾

Please don't keep submitting I129F. Ever since you guys started flooding with this loophole, NSC processing time has shifted backwards, affecting all the other folks who didn't submit I129Fs.

The delays have probably been caused by:

  1. A general increase in applications (people afraid the immigration law might become unfavorable for them in the future)
  2. Diversion of funds and personnel to the border\ICE,
  3. And\or the directives by current administration to slow down all kinds of immigration.

 

The the number of I129Fs is not significant enough to cause any major delays. Around a thousand I129Fs have been received by Nebraska year to date. Compare that to around 8500 I130 cases received just in October 2018. 

 

Blame Nebraska and the government, not people trying to reunite with their spouses.

I think I found the problem... it’s not 129f that’s the issue...

 

the original post is from F2a beneficiary... who has obviously forgotten that USC IR are not affected by PD unlike F2a beneficiaries who have to wait in line for a visa to become available. The problem is the length of her line, not 129f...

We should be the ones complaining then 🤣. IR1\CR1 visas are always available. The biggest thing slowing down our spouses from coming here are other cases in the system which will have to wait for visa availability when they get to NVC anyway.

 

However, I think the poster is an IR5 beneficiary (sponsoring parents of US citizen). IR5 has the same visa priority has IR1\CR1, however, there is no I129F for parents.

 

In essence, the two visa categories have the same priority but Nebraska is letting spouses get through faster if a K3 is filed. I can kind of understand his frustration. However, I still think it is misdirected.
