485 where to file:

The beneficiary of an approved Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, based on the eligibility category “Battered Spouse/Children,” and you are filing for adjustment of status.

 

765 where to file:

Pending Form I-485 based on:

• approved I-360 as a battered spouse/child, 
• as an abused spouse or abused child of a qualifying Cuban Adjustment Act of November 2, 1966 eligible spouse or parent.

As you can see, all they say is if you have "approved I-360", they don't mention "filing I-360 I-485 concurrently"?

Should VAWA package be sent to Vermont service center regardless filling I-360 standalone or filling I-360 I-485 I-765 concurrently?

 

Everything is mailed to Vermont including EAD renewals.

Hello I'm new to vj.

I'm male. My wife always threatened to call the immigration cops on me anytime we quarel. She locked d door anytime I come late. And always warn me to never visit my friends. I have been suffering depression since then. I always beg her like a slave anytime we quarel

We have first interview. And broke up few weeks after. She threatened to go back to tell the io that she is nolonger with me and they will report me.. I love her but she left me. Few months we got another interview.  Even tho we separated I still contacted her but she didn't pick up call. She texted with threat of deportation and restraining order. 

I hired a lawyer who went with me to interview and ask d io to put the 485 on hold. Luckily she did. Now I'm planning to file vawa.

The problem is that I dont have witnesses. My friends say they can't write about abuse but can write that we live together. 

I have done 4 counseling sessions. They diagnosed depression and anxiety.

I have police clearance from my city

Marriage cert

Lease

Xfinity

Car insurance

Dental insurance.

Few pics of us 

My ex have all pics of of us in her phone.

Driver license showing same address

My pastor also wrote me a good character with the church letter head.

 

The only affidavit I have now is from my brother who wrote that she has spoken to my wife b4 marriage affirming the marriage is real 

 

What are my chances. Pls help. I love u all btw

hi guys, I submitted my form I-360 7 weeks ago, but nothing yet, not even NOA, my questing is, if I later receive my NOA, what is going to be my priority date on the NOA ? the date they received my I-360 ? thanks

What you mean you got the C31 and the C09 is still pending !  

It means my VAWA got approved while I was waiting for my C9 EAD renewal..that's how I got the C31 EAD! The C31 is usually issued following i360 approval! And FYI I've been waiting for the C9 EAD renewal since Feb 2019..I see you said May 2019..and already very anxious...you might want to slow down a bit..be patient!😊👍

WOW! Sorry about all you have been through! The way I see it, your own affidavit is your strongest point..sought of! You need to pour out yout heart into the affidavit and explain everything from start to end do not mince words, don't hold anything back, put it all down! If your friends can't write about the abuse but can attest bonafide marriage and shared residence, then gladly take that! For abuse you can get the psychological evaluation report showing you have been attending counselling, were diagnosed, went through therapy, the outcome, and perhaps referral... Your family..can write about the abuse as well because they should be aware! The combination of your powerful affidavit, your family, and mental health practitioner report can tender a good evidence for the abuse requirement! Try to read previous post so you know the documents needed to file this petition! Also keep attending therapy!👍

it's not unusual to wait that long for NOA! Many folks here waited that much and even longer..but you can seek the help of your congressman to enquire on your behalf! Yeah your receipt date..that is when USCIS received your application turns out to be your priority date!😊👍

Iam trying 😭 but really everything is very slow !

and i have one more question for you , does the EAD C31 you received serves as Advance Parole too ? Or that’s something different ? Does everyone who get approved get the C31 EAD ? Or only who applied for EAD ?

The C31 doesn't come as a combo card..but the C9 can, only if you applied for AP! Most people I have heard of get the C31 following approval but few folks got c14 which is the EAD for deffered action! Yeah Vermont usually sends C31 when they approve your petition!
