no it is not a prima facie: it is a letter that i received after my 1st prima facie. a separate blue letter

It’s very strange I never received this blue letter I received 2 times prima facie but no blue letter

Is your ex threatening to withdraw the i485? If no then you can ask to put it on hold! It's less hassles this way! What is the reason your attorney gave for wanting to withdraw it? Huh? So he can get to charge you fresh fee? 😏 how convenient!😁 or should I say fresh? Anyway get proactive..ask him the reasons and tell him you prefer to put it on hold! I really need to know if your ex is disturbing..or threatening you in any way..especially as it concerns your i485! That way you can file a new one after closing the one pending for now..if this is not the case, then put your foot down! It's your life, your case and your money!!!

I have a similar situation like yours which I experienced during 2017. In my case what I did was I wrote a letter to Vermont explaining my situation along with a new application and attached the 180 days extension, copy of the expired EAD card and they actually processed it ASAP. If you have a lawyer then he or she must be up to speed with any discrepancies.

 

😊😊😊😊😊 Anyway I just hit my 30th month without any info about my 360 case. Even with the periodic status updates I receive every 2 weeks which are normal are no longer coming in thru text and email.

 

I have contacted the ombudsman, my Congresswoman and my senator about my delay........ Still 0 response.

 

This is not scare you as every case is different but please press on your lawyer as he/she can go over step further than someone like me who filed alone.

Hi ALL,

 

USCIS websites clearly states that I-360 and I-131 for VAWA application should be sent to 

75 Lower Welden Street
St. Albans, VT 05479-0001

 

but when it comes to I-485 and I-765:

 

485 where to file:

The beneficiary of an approved Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, based on the eligibility category “Battered Spouse/Children,” and you are filing for adjustment of status.

 

765 where to file:

Pending Form I-485 based on:

  • approved I-360 as a battered spouse/child, 
  • as an abused spouse or abused child of a qualifying Cuban Adjustment Act of November 2, 1966 eligible spouse or parent.

As you can see, all they say is if you have "approved I-360", they don't mention "filing I-360 I-485 concurrently"?

Should VAWA package be sent to Vermont service center regardless filling I-360 standalone or filling I-360 I-485 I-765 concurrently?

Wether it's filing i360, i485 concurrently, or filing i485 after an approved vawa, anyway you put it..as long as it's a VAWA related case, all roads leads to Vermont!!! That's where the party's at!!!😊🌠💫🌟 Vermont will be the one transferring your case to NBC..it's standard procedure!

You can submit anything with that letter
