I had one case he remarried  30 months  after he was divorced,and he had a long courtship (1.7months).He had 75 guests in his engagement party and 250 guests in his wedding. He got a RFE asking him  to explain why he remarried so soon, the officer wrote this “so soon”. I answered the RFE saying that his courtship was long,specially considering that in his Indian culture they get married after 2/6 months of courtship and there is no timeframe to fall in love and he fell in love  several months after he was separated , then you have an idea how USCIS thinks about divorce and marriage ,and he got his GC based on Vawa.

Don't worry. i have not even submitted police report as i am a victim of extreme mental torture. just add your medical reports, psychiatric reports, any psychological sessions you attend, statements from your friends/relatives saw you in a terrible mental state or saw an abuse

 

Also, the procedure is same if spouse is USC or LPR. the only difference is after your greencard there will be 5 years period to apply for a citizenship :-)

I can tell you right now that emotional abuse is just as traumatic as physical! You are eligible all day!!!😊👍

Thank you is there anything I can do while I await my appointment with the lawyer which is a month away. I’m trying to read through old threads

That would help considerably!👍 by the time you're done, you might be just as informed as the attorney or even more...😊 also start gathering all the evidences you can, to support your petition when you file! This is very important...as you read through the threads, you'll become familiar with what and what to gather and how the whole process goes including possible wait times!

Hmmmm! God is an awesome God, coz I wasn’t expecting this! Just like the 6 years driving license they gave me even though it wasn’t yet time. Well I shall keep you posted when I do receive the letter

I echo your sentiments ... when I feel despair, I come to this forum to find peace as well ... every approval here restores my faith and gives me hope . Every time I see members helping each other out , restores my faith back in humanity.

Most folks here used attorneys including myself so we didn't get to fill out the forms in any way...sometimes no answer is better than supplying someone with wrong answer! That's why I said you can't give what you don't have! Truth is often a bitter pill no one likes to swallow...everyone here is amazing...together we make this place intriguing and beautiful! No one is better than anyone else!!! It's a collective effort!!! Thanks dear😘💕 I appreciate your kind words. Some days I wanna shut the door, but my heart won't let me..It's hard for me especially when people are reaching out...calling out for assistance...It's the reason I always respond promptly! No one is getting paid out here..whatever we do it's out of the kindness of our hearts! All the efforts, time, energy..etc! But God has a way of rewarding good deeds! I wish everyone well!

I filed my vawa + new i-485 on August 12, 2019. My interview with the abuser was schedule for today. I went with my attorney and I was scared to death thinking of meeting him there so I stayed in the parking lot. Fortunately he didn’t show up ( now I know he didn’t receive the appointment notice)and my attorney was able to talk with the supervisor and gave him the i-485 withdrawal letter ( I didn’t want to ask to hold my i-485 so  later on I can explain to the abuser that I’m applying for other category of visa- I know Vawa is confidencial but he would suspect) . The supervisor told to my attorney to make sure the address that they will send my withdrawal receipt is safe and he said he won’t take any further action and my case will start again now through my vawa.

I am sorry you have to go through this BUT you do NOT have to anything to your abuser! The lawyer must had told you the already.

Protect Yourslef!

@AAh23 same case with me, all was base on cruelty and mental, I submitted medical reports from general Dr, Psychiatrist, Therapist, pictures of emails, texts very self explanatory of the gaslighting, etc... plus all the documents required. Good Luck! 

After 27 months from filing I finally got my GC Approval.
