Hi, yes! I received a RFE 3 months after filing (November 2017) for good faith marriage and good moral. 17 months after apply I received another one asking for: shared residence, good moral again and abuse.Β 

They received my answerΒ 06/28 and I'm freaking out waiting for their decision...

I could be wrong ...but somewhere in this forum I read that when they approve you , they delete the files and update the status to approved ...

didnt someone mention the same fee days ago ....

you don’t have a inadmissibility bar ... so there is no reason to deny ...

House I am confused on this issue if the marriage is not good and you are no more living with your abuser you still have to wait for 3 years not to get divorce so that you can get your citizen ship this is quite confusing going on please can some one explain clearly.

If you are abused by LPR spouse then you apply at 5yr.(unless you show the LPR naturalized)

I have a question suppose you got married to the the abuser in 2017 in 2019 your VAWA got approved you got the green card and then get divorced.

so my question is when you will be eligible to apply for citizenship even though you got divorced in 2019.

If you get your green card through VAWA, you apply for citizenship after 3 years for citizenship spouse and 5 yearsΒ for Legal Resident spouse years regardless of whether you stayΒ married or not. The person who posted that you have to stay married to file for citizenship after vawa is approved has it mixed up

If you filed a VAWA self-petition on Form I-360, or a VAWA-based abuse waiver with Form I-751, or received VAWA-based cancellation of removal, you may take advantage of this three-year rule if you were the abused spouse or child of a U.S. citizen and meet the additional criteria described below.

If, however, you are married to a lawful permanent resident (LPR), not a citizen, then you must wait the normal five years as a green card holder before applying for naturalization, unless your abusive spouse or parent naturalizes.

Naturalization Eligibility for VAWA-Applicant Spouses of U.S. Citizens

If you are a battered spouse of a U.S. citizen who was granted approval of an I-360 or I-751 or cancellation of removal on that basis, and you have been an LPR for at least three years, you can apply for U.S. citizenshipΒ now, without having to show that you are still residing with the citizen spouse.

In addition, it does not matter if you are still married to the citizen or divorced. You can also apply after three years as an LPR if your abusive spouse has died.

This is an important benefit, because while the non-VAWA spouses of U.S. citizens can also apply for naturalization after three years with a green card, they must prove that their spouse is still alive and they are still married to and living with the U.S. citizen.

If you got your green card in 2019 through vawaΒ and you were married to a citizen, then you will be eligible for citizenship in 2022 (3 years) and if you were married to a Legal Resident then its 2024 (5 years)
