I don’t know how you guys are dealing with your anxiety but I’m completely freaking out. The abuser will never allow me to go back to my country with my little girl if they deny my vawaΒ and imagine this happening is torture. She is completely dependent on me. I don’t have many proofs of residence - only 3 lease agreements but noΒ bills or joint account together.Β Β Everything was under his name. I do have statements of him transferring money to me for paying the bills.Β Β We had a prenup together and it was totally one side stating that he will never give me any alimony and making me giving up of any rights I could have. I attachedΒ it as proof of his control over me but now I’m in doubt if I should have attached it. I don’t know how immigration would Β understand it. I’m wife number 3. He did the same with with number 1 and number 2.Β

this should be no problem especially if you already had a pending i-485...Β 

I only sent lease with my name and his on it too. Dont worry!

USCIS asked me to provide extra proofs of extreme cruelty in order to qualify for Vawa and I did submit so many evidences.Β 

1. Personal affidavit - 15 pagesΒ  (includes humiliation, isolation,Β Β immigration threats and financial abuse by my wife)

2. My father and cousin's affidavits ( they explained my depression, anxiety attacks and degradation by my wife towards me)

3. Medical records( psychological sessions, depression evaluation, TMJ due to stress and detailed psychiatric report)

4.Β  Hotel receipt and explanation in detail (when my wife thrown me out of her house)

5. Credit card statements ( she took control of my finances)

6. Police clearance from my home country (they didnt ask but I submit it)

7. Tax return and W2s (2017 and 2018 - they didnt ask but I submit it)

8. Chat session with national domestic violence representative

9. some other supporting evidencesΒ

Asking as a general situations: If a VAWA case was denied due to a lack of providingΒ Β proof of entering in a good faith marriage and the person didn't know she can contest so she just let it go. Afterwords she got married to aΒ  USC and he submitted I485 for her. Anyone had a similar situation, how likely is for the I-485 to be approved? Thanks.

Thank you dear friend. I know you always motivates me and honestly it feels amazing. I added as much as detail possible in my affidavit. :-) it took a lot of time to gather all the evidences but its worth it. i wanted to submit my RFE asap but its okay as I provided them with sufficient informationΒ

I guess everyone has their own peculiar way of dealing with stress etc...vawa says they will accept any credible evidence...submit anything that supports your claim..including the funds he transferred to you for rent payment, affidavits from landlord, tenants, family and friends..confirming your words...you can not produce what you don't have so give what you can! These officers are trained and know that all situations are never the same! I didn't have alot of documents because of the peculiar situation I found myself in but got approved still..they know how they handle different situations! And they also know when you do not meet the criteria..it's two different things!πŸ‘
