I want of seek advice for my situation, my ex ad I separated last year, I have a child from a previous relationship so the child isn’t is, during the separation he emptied our bank account and claimed my child as dis dependent, when I found out I asked him to return d money but hasn’t done so, he is using the money to negotiate his way back to the marriage, he said if I want him to return the money I should allow him to come back home which I ve refused. He is now threatening to interfere with my green card application. My family has adviced I leave the money for him and not pursue to recover it, for fear of what he will do. I am really angry because I have gone through a lot because of this man and to lose my money just because I am afraid of retaliation I can’t bear..What do you pple advice because I am abt to file an amendment to claim my child. I don’t want him to win. Meanwhile I am still in hiding as he has threatened to have me killed, I have a restraining order but that hasn’t helped

If he’s the type who’s willing to go so far as to make death threats and your family members know him, I would drop it. I know it’s tough, but, you only have 1 life while money comes and goes and you always have the ability to earn more money.

Can you speak to the bank? I assume like pinklion said IRS and accountant won’t be able to help either when it’s a joint account. I’m sure that by now he must have either spent it or hidden it away. Going forward, I would say speak to a bank rep first and if I were you I would take out and move all your things to another bank. I would open a new bank account, savings account, debit and credit cards and anything else to be in your own name. Talk to a financial advisor first. Is he doing this as part of something bigger like filing for divorce? Asserts, liabilities, paystubs and and all forms of income have to be disclosed in order to finalize divorce. If it goes that way, the judge would consider these facts and look at these factors to make a determination in your case. Make sure he does not misuse your funds and go on a spending free by saying it’s a joint account and hold you liable in the future and you too will be held responsible for paying that debt off as in some states  marital debt is split equally.

If I were you I would keep records and have documentation regarding this issue and close this bank account. I would not use the current bank account anymore because he might misuse your funds without your knowledge and consent in the future too.

This is the continuation thread for

https://www.visajourney.com/forums/topic/709304-vawa-part-14/

which has been closed because of its large size.

It was wonderful to see so many approvals and so much progress in so many cases in Part 14.

I personally hope that everyone who posts in this new thread will enjoy the same.

@TBoneTX Amen!! From your lips to God's ears. We embrace our approvals with open arms as I declare by faith they have arrived 🙂 Thank you so much for all that you do, and may you be blessed always. Have a blessed day ahead 🙂

I’m confused, though. How can he claim her as a dependent if he’s not the biological father and she’s your child? As far as I know, ability to file dependent claim is based in mutual agreement sanctioned by court either on an alternate year basis or to the parent who gets legal custody.

You can report him probably but I don’t know if it’s worth your time, effort and energy.

Hi @HopeN

Now you are out of the situation and working, please focus on your own well-being and your child’s. Make sure to keep proper records and document everything. If you have a competent family law and immigration attorney, they will give you solid guidance. Now, the next step is his move. If he doesn’t want to be found and even served with divorce papers, then hopefully he will leave you in peace. If he’s not active in his child’s life, I hope he doesn’t file papers seeking sole child custody. More than the immigration part the divorce and child custody (family law) aspect takes a huge toll on you, emotionally, psychologically & physically.  I understand what you are going through with this manipulative bully because my ex too is a very educated, well off and well connected person and it’s ashtonishing how easily they are able to get away with their lies and deception based on how others perception of them (that the not as a threat). In my case though, the judge was eventually able to see trough my ex’s manipulative and bullying personality, it took almost 4 years, though. If you can avoid court and settle out of court, that causes the least damage and suffering but it depends on what he wants and his demands and if he is fair and reasonable he is to you. Don’t worry, if you have backing from your psychologist/therapist and findings in their report to substantiate the control and power dynamics and emotional, psychological or physical abuse, you will be fine. Don’t fear and hope you make have the conviction and self confidence to move forward with your life & give your child a loving and nurturing home environment. If he’s happy with visitation or only interested in that, I’m assuming he won’t want to go to court to seek sole custody just to punish you for leaving him. Some men will detest the idea of having to pay for child support, spousal support and spend lots of money fighting for sole custody due to their own bruised egos and to spite you rather than out of care and concern for their children. Wish you all the best!

@namastenyc thank you!! I couldn't have said it better myself. Those wicked, soulless people think they can get away with anything till an impartial judge sees right through them in court and brings them to their knees. My ex and his idiotic lawyer kept falsely claiming "she's on deportation list" because he withdrew his petition, and the judge said to the lawyer "don't bring that to my court room, this is not immigration court", I was dancing in my heart, I got full custody of our children, and the judge denied ALL his requests, everything, including for reimbursements (the mad man was asking me to even refund him money he paid for our children's school lunch, his OWN children, his flesh and blood). Such pure wickedness, but God has stolen his peace, let me leave it at that or else I'll end up filling this thread and 20 more with my experiences with him. We thank God for sparing our lives and for victory!!🙏

Thank  for your reply. I did not understand, unfortunately. Can I apply from another country? In this case, I must indicate the address in the USA, for example, a friend, so that the answers are sent there? For a friend to send me answers from them?

She told you just like I did too that you can apply from another country..I really can't give you wrong information so I'll say I'm not sure about you using a friend's address in USA while you reside in Russia! I don't know the implication of this to you...not to USCIS as they will send mails to the address provided though! Best you listen to what the attorney already told you..

Hey Everyone!

I got my EAD card already and have a pending I485.

I want to submit Advance Parole I131.

Do I need to submit more passport photos? Or will they use the ones I sent already?

Do I have to submit a new fee waiver?

Good morning to you members, am grateful to God this morning for the gift of life! Now I got a question? In October last year I sent a renewal of my work authorization which was from the i485 that was denied before I filed the new one, so last month I raised sr, and it went through, am not sure why I did raise it but anyways I raised it and it was worked on it. This morning I just got an update that they transferred the case to my local office, my question is do local office approve work authorization? Am kinda scared 🤥🤥

You have to complete the entire application and submit everything as they do not know anything.

Good morning!

Yesterday I finally received the NOA for my I-485, EAD and advance parole!

I still haven’t received NOA for the I-360. When they send my I-485 package back (I used old forms) I saw they had the wrong zip code for my po box. Since I moved out and no longer live with my husband I used my current address for the new forms. Should I send a change of address form the the I-360 and request a copy of the NOA? Do they send a copy of the NOA again?

Also, does anyone know if I’ll have to do the biometrics again? I had it done before for my old EAD

Thank you.

Now the waiting begins!!
