At the local office an Immigration Services Officer has the discretion to request that a currently pending Advance Parole application be expedited rather than issuing an emergency Advance Parole document. At the info pass you will submit an Emergency Advance parole application and this also have to be process and evidence of your extremely urgent situation must be review so it also takes time. I don't know if they are issuing Advance parole document on the spot.....

If she has an appointment with USCIS and has a pending AP then she will be able to get the AP within of hours,if she can prove is an emergency. All Uscis offices handle Emergency Advance Parole.

You mean you still had to go for the marriage based interview after sending them a letter to hold the pending I-485 ?  If so, you were already divorced before the interview? Did you not send the divorce decree to USCIS to update I-485 records?

i got my congresswomen involved because i wanted to make expedition she told me that the USCIS told her that the application was transferred to vermont and it will take a while until they receive it and process it !!
and yesterday i got this notice ..

what that mean ?? I did not go any fingerprint appointments ! very confused ??
does this mean vermont received the application ?? And they are using my old fingerprints they have in file ??
or this is just system glitch ????

That's right. USCIS scheduled my marriage based interview, they never answed the requested i made to hold my i485. I was not divorced when i applied for vawa and made that request so i did not have any Divorce decree yet. The day of my interview i brough a package with all the updated documents and then the final Divorce decree and again in written a request to have my i485 based on my i360 not the i130.

The Officer asked me if i was alone and i said yes then i explained to him about the VAWA and gave him all the papers. He told me that he was sending my i485 to Vermont to be adjudicated with my i360 and it will remain pending. The same day of the interview he approved my EAD C09 renewal that was pending based on my i485.

Hello Vawa family. Been away working on my application and trying to get everything together.    Congrats to all the approvals and I’m praying for all the ones who are in process. I have an important question. Anyone has ever filed for vawa after having more than one marriage to a USC but never filed any paperwork for AOS? I want to know if I should include previous marriage to USC in my declaration/affidavit?  Or should I just talk about my last marriage on which the vawa is based? Please, anyone, knowledge on this is needed. Thank you in advance.

You Vawa Case is base on your last marriage where the abuse took place, I don't think previous marriage is Relevant to USCIS... The only thing they will need from previous marriages is the divorce certificate demonstrating the that marriage was legally terminated.

They are using your previous  fingerprint on record to process your I-765 Renewal and also receipt number starting with MSC belongs to National Benefits Center, Not Nebraska Service Center Nebraska receipt numbers start with LIN. Your lawyer sent to NBC (National benefits Center), the lowest service center right now, I recommend you to get a letter from your employer requesting EAD expedition so your congress person can sent it to them and they can transfer to Vermont Service Center and Vermont can Expedite ... This is a little frustrating, lawyer make this mistake often.... Hope you get it resolve soon.

When the person attends the interview based on the l130 not on the l360 the person has to go to a second interview after Vawa approval, despite I saw 4 cases they approved the AOS without the second interview .

Hey All,

Anybody has changed their address after VAWA approval? I had sent a change of address 3 months  before they approved it but they never changed it...

my current office would be Miami office and I moved to another city in the Palm Beach County. Anything I can do other than notarized letter?

Also, what happens if I have an expired combo card (advance parole and EAC) and I want to apply for an AP? Do I file a new application or is it renewal? Will an AP application delay the transfer of my file to my local office?

any VAWA applicants from South Florida waiting on AOS interview notice out here? I’m an Aug 2017 filer

thanks in advance ❤️

Are you saying page 3 1a we should check "VAWA self-petitioner, Form I-360"?

Yes. Otherwise it will be rejected as stated in the post earlier

So Sandra, once we (or our lawyer on our behalf) writes to USCIS to put the I-130 based I-485 on hold after applying for VAWA, are we to expect a letter back from USCIS acknowledging the hold?

Just trying to understand and so I am not taken by surprise later.

Uscis usually doesn't send any letter about holding the i485 in abeyance. They just effect it online..you may see that the case has been transferred to Vermont..like in my case..they sent me a transfer letter then...that's one way to know it was held..another is through infopass!😊👍
