VJ family, hope you’re doing fine.

I went in for my interview and it was a pretty pleasant experience! Wait time was short too. I got called on 15 mins after arriving.

IO was friendly and cheerful.

We went through my biodata and yes/no question.

He only asked for my medical records and then told me he is approving my case and I’ll receive GC within 4-6 weeks.

Whats odd is that he did not ask for my divorce decree. I went in prepared to only give what asked for.

I also submitted my BC name correction affidavit as well. Basically I had a sheet of paper explaining changes since I first filed the I-485.

He mentioned that low cost health insurance isn’t considered public charge.

plus he did not at all ask about the abuse, bless him!

And I saw a big brown VAWA file on his desk which means they do have access to our files even after adjudication!

I’m yet to receive approval updates. Case status is still the same.

Will update you all as I receive approval updates and GC. Thanks for being part of the journey folks! Praying for each and everyone here.

Congrats!

Yes I believe so thanks

Do you have a copy of the 485 you sent in> ? Can you check it is filled out correctly- specifically 1a. should be check that the 485 is on the basis of 360 VAWA. Im thinking maybe you filled it out wrong... If not you should probably wait for the NOA from VAWA to file it again. I think if you send it before with out the NOA it will get rejected again.

Divorce is not mandatory ,all officers ask if the person is divorced ,it’s part of the interview .If the person is still married just has to say “I am not divorced”,that is it and the person doesn’t have to show that filed for divorce or that the person will file soon.VAWA  Law does not require the person to be divorced to obtain the green card

Totally correct BUT they are still asking for the document at the interviews.

My officer kept the original copy, I express this so people can be ready to answer when they have the interview.

Myself I had all done so I just handed it to him.

Hello Vawa family. Been away working on my application and trying to get everything together.    Congrats to all the approvals and I’m praying for all the ones who are in process. I have an important question. Anyone has ever filed for vawa after having more than one marriage to a USC but never filed any paperwork for AOS? I want to know if I should include previous marriage to USC in my declaration/affidavit?  Or should I just talk about my last marriage on which the vawa is based? Please, anyone, knowledge on this is needed. Thank you in advance.

A woman I know well had the same situation many years ago. She had been married to a USC, never filed for AOS (there was no abuse in that marriage as far as I know), then divorced him. Then she married another USC, and he turned out to be an abuser.

She got approved on her I-360 and got her green card based on abuse.

I think you should tell your whole story in your VAWA petition, and explain everything without hiding any facts. Truth always rules (and also proves your good moral character). Best of luck!

Dear John can you please share your time line and do you have any police report or a court restraining order or protective order so as to show the abuse in your VAWA case
