You can try but I don't think they will approve the tourist visa  because the law says that all potential immigrant should be barred from entering the U.S with a tourist visa and you are a potential immigrant because of the VAWA,  and of course you must tell the truth, you can't just say that you are coming here to visit the U.S, It will not hurt your case.

 

If you were in the U.S without status for over 180 days but less than one- year then you have a bar to reenter for 3 years using a tourist visa,the bar doesn't apply to VAWA petitioners.

My I485 through martiage was denied on Sept 17. I was putting my VAWA application in order and it is ready for filing. On Thursday I have a hearing regarding restraining order. Now - file VAWA or no? What are my options?

Temporary restraining order is in place for 15 days. Now after receiving this letter today I feel like a zombie

If you were abused you can file Vawa now and refile the AOS as well, it's not a big deal. Fill out asap and once you receive the I-360 and I-485 receipts  then send a copy of the receipts to the local office that denied your AOS and ask them not to issue the NTA until final adjudication of your case.

It takes longer time for USCIS to send anything back

It might take 3/6 weeks to cash the check and get the receipt,  then don't panic.

I also think that this correspondence is not related to VAWA.
