Can I apply for a tourist visa to stay in the country? Now I am outside of America.
I can honestly tell my situation at the interview.
Could it hurt? wrong for me.

To my understanding, you already left the United States of America willingly on your own and your I-485 was cancelled/denied  already . If you came on a visit visa earlier and tried to Adjust status through marriage, you overstayed your duration and that’s an automatic ban already . It’s a clear law that if you overstay by 180 days or less than a year, you get a ban of three years and overstay more than a year, you get a ten year ban . I think @sandranj already told you that in a couple of pages back that you need to wait until your vawa is approved. But, to answer your question, going to a US embassy for a tourist visa is a waste of time and your money . Focus on getting your self a job in Russia, attend therapy there and get your mind of all of these until your I-360 vawa is approved.

The intent of a visitors visa is a short stay 6 months or less and return home. You have nothing supporting you would return to Russia. Also, You would not be approved as you have clear intent to immigrate to the US. They can see your VAWA application in the system. 

 

Focus on working or volunteering at your son's school to occupy your time.

How long has anyone had to wait here before they receive the form I-360 receipt  from Vermont ? Two weeks, four weeks or two months . ? Who’s still waiting for a receipt from Vermont ?

If you are only filing i360, on a form it will give you an option to select if you need a work authorization and they will send you one after your vawa gets approved. If you are filing it with i485, you can apply for i765 and i131 with no fee  and make sure to add category c09

It takes longer time for USCIS to send anything back

It took me about 4-5 weeks to get the receipts and for the check to be cashed.

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

Hello

 

I justvreceived some bad news today...

My I485 through martiage was denied on Sept 17. I was putting my VAWA application in order and it is ready for filing. On Thursday I have a hearing regarding restraining order. Now - file VAWA or no? What are my options?

Temporary restraining order is in place for 15 days. Now after receiving this letter today I feel like a zombie
