I urgently need help. I went to defend my self with the help of a pro bono preparing my court documents last year when there was eviction noticed served on me and my abuser.

However, i was long kicked out of the apartment by my abuser before the eviction noticed came. So in the strength of my case with evidence of rent paid. The court judgement says I was not liable for the rent and fees owe and that they will pursue it with my abuser. The property attorney and the manager of the property were there at the court.

To my greatest surprise and distress I received a mail from a collection agency yesterday. About the outstanding of about $4000. They were actually threatening me. It was too bad. Same today few hours ago.

I believe I have a good case based on the strenght of the court judgement. But they insist I was still on the lease. 

 

I need an attorney to help me on this. I dont have money. An attorney, a pro bono that can help on this kind of situation.

I am based in California, Fonatan city to be specific. Any advise on how to go about this appreciated.

Please dont be afraid of the collection agency. They can send mean letters and its very upsetting but dont let it drag you down. CALL THEM. I know that sounds scary but its the best way to resolve this. Simply call up and tell them you have a judgement saying you are not responsible. There are online fax services you can use to send the documents to them for free. You shouldnt need an attny unless they are not agreeable. Even then the next step I would take if you are unable to resolve it with them is to speak to the prior property manager. But first start by speaking to the collection agency and see what they need from you to remove you from the debt. You can PM me if you need to.

I got my hospital record today stating that I was admitted with High blood sugar, high blood pressure  and abrasion on my left upper arm and left fore arm and a headache from contact with another person..   • i have a hearing at the court regarding restraint order. Thing is I really dont want to go bc I will have to survive that all over again inside me and that causes an extreme stress and discomfort. Should I go or no, send a letter to the judge? I need that restraint order in a effect bc I git a lot of nasty txts and e mail with threats etc? Should I include those as an evidence in my petition?

Definitely go to the restraining order hearing. It is not as bad as you are imagining. Since its in a court setting you will not be alone with your abuser nor will you have to speak to them directly.

I think you're fine! If I read correctly..you said you filed VAWA (i360) and i485..which made you eligible for the work authorization you are currently in possession of...so you're good!😊👍

I don't have a receipt notice of the i360.................... !! I only have a receipt notice of the i485................ please help me.......... what do i do?

Did you use an attny? Do you have copies of what you filed? You most likely did file the 360 if you got prima facie for it or a c31 work permit.

Did you use an attorney? You should enquire about your receipt notice! You can write a notarized letter to Vermont and also enquire through your congressperson!

No i did not use atty. my work permit is c09 and I do not have a receipt notice of the i360.......

You have a prima facie! That's awesome..and a good proof of the petition! Now write to Vermont and contact your congressman like I adviced!👍

Yes, my work permit is only basing the i485 because my ead is c09 category. But the i360 I did not submit.  Please if anyone of you here a lawyer who can help me........  how do i submit my i360?   :( Maybe it's always good to hire lawyers to file because to less mistakes............ I need help guys......  Can I still submit my i360?

I think you may be confused about different paperwork and what they mean.

Lets start at the beginning. What visa did you enter the US with? Did you ever file ANY paperwork with your spouse? Was your spouse an LPR or USC? Finally what does the prima facie say? Here is an example of a prima facie for VAWA=

 

 

Notice how on the letter it states what form was filed. If you have a prima facie saying its for form 360 with the receipt number then you did file the 360.

In an earlier post you mentioned that you filed VAWA in October of 2017 and that you're getting anxious about the delay...that's what brought about this extended exchange....so how is it that you're saying you didn't file the petition again? How did you receive prima facie if you didn't file? Check the documents you have in your possession again and let us know what really is... @sandranj please our able attorney your attention is once again needed!🙏

Prima facie says: I-360 Petition for Amerasian, widower, or Special Immigrant

But my EAD is c09 Category, why is that so?  It should suppose to be c31?
