silent watcher here. Following site for a while but this is a first post. After quite a while I decided I will have to file for Vawa - have no choice anymore. I was mentally abused by my spouseΒ  for a while but last week it turned into physical attack with another male included . I ran out of the house barefoot and called 911. They immediately showed up asking me what happened. ER was invited as well. Being diabetic that caused an extreme stress and I was sent to the hospital right away with blood sugar measured on the spot of 584 (people easily die with that levels) I was stabilized at the hospital - they noted abrasion on my left arm from pushing but still waiting for the hospital records as well as police report. I developed diabetes bc of mental and sexual abuse and deportation threats that I was going through last 2 years.

Currently with no place to stay - trying to find shelter but they are all full pretty much. Basically have an idea how to file I360 - working on collecting evidence but being out of home not so easy to collect everything. Filed for a restraint order and approved the sameΒ day but ran out of medications, place to stay etcΒ Will have to ask for police assistance tomove out. How to link my diabetes that is definitely developed from horrible abuse with Vawa case?

TIA

Unfortunately diabetes is not a result of extreme cruelty ... it’s a metabolic disorder.

you have enough evidence - especially ER visit , 911 , restraining order . Don’t worry you don’t need to link diabetes to cruelty, yes you can say that it was left untreated due to issues in your marriage.Β

Contact Sandra and see how you can proceed forward ... all will be good ... keep your head high and chin up you have faced the worse ...Β

Can I attend psychologist sessions from another country? Will this be taken into account when considering the case?

How much does a visit to a psychologist matter? Is it necessary to do this?

Hugs

and Thank you.

If you don’t have a police report or hospital record showing the abuse then you need to have a psychological evaluation done.Uscis will consider a psychological evaluation done abroad but of course you need to have the evaluation translated to English from your language .

Ran through your post briefly and reassured you earlierΒ that gender is not a problem in VAWA petition! But I've taken my time to read it thoroughly..you do have a case..you should work towards collecting evidence and putting down your ordeal in writing..this will make the affidavit you need for your case! You don't have to link diabetes to your psychological turmoil..that is an insulin problem! Get the medical report from when you were rushed to the ER..also endeavorΒ to attend therapy...although either will do..but having both is a win win! Gather all the reports you posted about..police, restraining order..and also other documents to support your VAWA petition. In your free time, read through previous threads to get a feel of where you stand and the kind of supporting documents to back up your petition!πŸ‘

I feel like to cry. I think you already qualified for vawa just gather your evidences asap and submit it to the VSC. I am so sorry you had to go through this 😞 We all are a victim of battery/extreme cruelty so we can fully understand how it feels.

Morning.

I am here again bothering you all :-) but since you all are my family so I love to bother you allΒ

I am thinking to apply for I131 along with my I765 but I am attaching a fee waiver to give it a try. I wanted to follow up with a person who attached fee waivers before and accepted by USCIS? I do not have money to pay and i guess that would be an insufficient reason to apply for a fee waiver. What other reasons i should mention in fee waiver form to qualify for fee exempt for my I765 and I131?

Β

Thank You

I was at the psychologist today. ThankΒ to everyone for the advice, in a week I will go again. The psychologist confirmed that I am in a state of depression and that I must go and practice. And what happened is abnormal, this is the real violence that my son and I experienced.Β I have to deal with a psychologist to love myself again.

Hugs.

Get Form I-131 Fee Waived When Filing Concurrently

If you are filing Form I-131 together with the Form I-485, Application to Adjust Status, you do not need to include a filing fee for Form I-131 as long as your adjustment of status package includes payment for the Form I-485. You will need to include supporting documents for Form I-131 including:

  • Copy of government-issued photo identification
  • Two identical passport-style color photographs

Refer to theΒ USCIS filing instructionsΒ or your CitizenPath filing instructions for more detailed instructions on supporting documents and where to file.

File Form I-131 After Filing Form I-485

If you have already filed Form I-485 and it’s still pending with USCIS, you may file Form I-131 without a fee. But it will require some special handling. We recommend that you include a cover letter so that there’s no confusion over the missing filing fee. You’ll also need to include proof that you have a pending adjustment of status application. In addition to Form I-131, include:

  • Copy of government-issued photo identification
  • Two identical passport-style color photographs
  • Copy of I-797, Notice of Action, receipt of filing I-485
