What happened to your marriage to the American? Is your son his bio-child? Why did you leave the US?

Ok so here is my situation. I filed i485 and i765 and paid a fees of $1220. My ead based on c09 experied. My attorney made a mistake and at the time of renewal, he used vawa c31 category instead of c09 which is pending i485. Now, i haven't receive my EAD yet as it is obvious because of wrong category. I want to apply for another one based on c09 as my i485 is still pending. that's what i wanted to ask if i can apply for a new c09 without fees

That’s exactly what my lawyer did. So I filled myself to renew co9 . At first they asked for a fee, then I made a copy of what I sent you and mailed it back. It was approved in less than 2 months without fees.

This information is well appreciated . I guess this solves the questions . You don’t have to pay if you filed the I-485 and I-765 C09 jointly and paid the fees (1,225$)

thank You :-) fee part is cleared. now again i have a question. my c09 ead expired on Mar 22 6 months before. I can still renew it without paying fees right?

Yes you can . As long as your initial AOS green card application is still pending . Just attach your I-485 reciept showing the initial fee you paid . And include the other requirements (not forgetting your vawa receipt . And send to VSC

But,I heard a rumor that if you send in a renewal after it expires, you don’t get the 180 day extension. But,I stand to be corrected . Like I said, it’s a rumor.

I heard that too 

I think you need to get this clarified

your EAD did indeed expire 

my 2 cents 

send the filing fee check 

if uScis want it they will deposit 

if they don’t require it , they will send it back 

why play the merry  go around of rejection just for the lack of a filing fee
