According to this link, Vawa can only be submitted while in the United States, but Sandra wrote an answer here for me on the forum. And she said that you can mail post from another country.
I'm completely confused. Will my case be accepted for consideration?

hugs.

Thank you.

We use a lot of abbreviations in the forums. When people say "VAWA" packet they are referring to the standard procedure for people in the US. YES! You are still able to file VAWA from overseas. You will just use a different process. For people in the US they send the 360 and use the 485 Adjustment of status to get a greencard without ever leaving the US.

You will use the 360 and then once approved you will deal with the NVC and then the Embassy. You will interview at the Embassy and will get a visa printed in your passport. Once you enter the US with it you then will follow the steps to get the plastic greencard in the mail. You will have LPR status though as soon as you enter and will be able to get a SSN if you dont already have one and immediately work. You wont have further dealings with USCIS once in the US until you naturalize if you choose to.

Some one just posted they are still waiting 8 weeks for a NOA receipt. (US mailing addresses). So you may want to wait a while longer since you mailed it early Aug.

Okay LOOL.. They are in 2018. Also do you think its advisable to change my address, I am still in the same building but just changed my apartment unit. I forwarded my mails with USPS. whats your advice on that? I was hoping I can change at the interview.

L.A here I come! 📦 🚆 🚚😂😂😂 since you're in the same building..it's not that bad..you get access to your mails..and you can still correct it with USCIS at the interview! But if it's not any trouble you can still update it following normal procedure..Vermont..notarized..the works!😏😂😂😂

How can I ask to keep 485? Thank you)

Once you left the US your I-485 was deemed abandoned and it was denied.

Writing Vermont is a hassle... I hate that you cant call them sometimes even though I understand it's for our protection. If usps will forward it i'll wait till interview to change it. And I also didn't cancel my informed delivery at the other unit so hopefully I will get an email/ also if there's a new person in that apartment she might override my informed delivery lmao!  I have seen people say here that USPS don't forward USCIS anymore. How true is that?

I agree! Well since you're almost done..you should update it at your interview! As for the forwarding of mails....I really can't verify that to be true...or false for that matter...will research that..😊👍

I am truly confused at this point .

if your IO denies to hold your 485 on hold at the marriage based interview .

then you can refile a new AOS and can be C09 category ( USC spouse )

this is called as concurrent filing of 360 with new 485 ( AOS ) .., then you wait for 7/9 months for your EAD C09 to come through this new AOS .

then why was it told that the person needs to wait for C31 EAD

Why ?

This is really confusing me ...

also a few days ago Sandra clarifies to Villanova post that if IO refuses to put your marriage based 485 on hold then you simply can file a new AOS with C09 category the next day ( if your spouse is USC ) and u will receive EAD in 6/9 months.

yet so many lawyers misguide you and say 485 cannot be filed until I-360 is approved even when your spouse is USC

i want everybody to get a clarification on this because VAWA takes time and if we can work during this time then we should not get misguided and misinformed and lose that opportunity to work just because these lawyers misinformed us

please people pour in your opinions and help us through

People get wrong information about  VAWA because there are tons of bad immigration attorneys out there. If the person is married to a U.S Citizen the person can file I-765 category C9 and he/she will receive the work permit BEFORE VAWA APPROVAL. The person can file form I-485 and choose the option  YES  for  USCIS to issue a work permit and then USCIS  will issue the EAD category C31 AFTER VAWAAPPROVAL, that being said the person will have two work permits.
