No. submit it again with fee attached. i360 is free but there is a filing fee of i485 and i765 and i131 is included in it. or may be your attorney did not added details why you want a fee waiver

it will be okay, you can file a vawa before your i485 interview and attach your pending i485 receipt with your vawa application. they should adjust your i485 so you do not need to submit another i485.

You are correct but in this case the interview is already scheduled..so it will depend on how fast the petition can be filed and receipt gotten before the set interview date....the chances be looking kinda slim😏💁either ways she has to attend the interview and somehow convince the officer to hold it..with intent to file the i360 petition ASAP..who knows...miracles do happen!😊

sept 18  2017 i485, i131, i130, i765 sent

 

oct 26 2017 rfe for i485 ( affidavit of support not up to required amount on tax returns)

 

Nov 26 2017 rfe response sent

 

dec 2 2017 rfe received by uscis 

 

dec 6 2017 biometrics, I was never invited for biometric I just summoned courage and went there (uscis office)after waiting for long and I was scheduled for same day

 

march 13 2018 filed vawa using a lawyer

 

march 18 2018 uscis receives i360 docs

 

march 19 2018 i765 and i131 combo card approved based on pending i485. Lawyer wrote to uscis to keep my i485 and attach it to my vawa app.

 

march 25 combo card received

 

march 28 2018 wife filed for divorce. We were separated already since Jan 2018

 

april 13 2018 received first premie facie for one year (from March 13)

 

july 26 2018 divorce finalized 

 

oct 2018 applied for combo (131 &765) renewal

 

jan 22 2019 combo card approved

 

April 2 2019 prima facie extension for 6 months

 

august 2019 renewal of combo card (c9)

 

sept 3 2019 card in production notification for i360

 

sept 9 2019 ead card (31) received my lawyer.

 

i believe that some march 2018 cases are being worked on right now.  I just want to say thank you to Sandra and everyone on this forum. You’all Gave me hope. And for everyone waiting for approvals, yours will come soon. The journey will end in praise.

Go to your interview, talk to IO without spouse. Explain your current situation. If spouse has not pulled I-864, you can be approved and will have to ROC for extreme cruelty. If he pulled asked IO to hold I485 for VAWA. If IO doesn't hold don't worry.

USCIS are for some reason rejecting the fee waivers on some cases...maybe you didn't support your waiver with proofs as to why the fees should be waived in the first place..turns out they need their money..💰 Christmas is over! My my attorney didn’t attached any proofs. She only explained why I couldn’t afford. She told me that usually they waiver the fee for vawa petitioners and I didn’t worry about it at the time. I hope it doesn’t delay anything.

My attorney didn’t add any details. She only explain in 5 lines why I couldn’t afford. 😔

soon as your attorney encloses the fee and sends the package back to USCIS, they will begin processing of the i485.😊👍

it has to be in details why you are requested for a fee waiver

i think both are not linked with each other. if asked, you can explain why your divorce is still pending

You can use this link to find your local office.

According to this link, Vawa can only be submitted while in the United States, but Sandra wrote an answer here for me on the forum. And she said that you can mail post from another country.
I'm completely confused. Will my case be accepted for consideration?
