I know that it is stressful but the best thing that you can do is to be patient and to get yourself to be busy as much as possible, otherwise you will go nuts

Hey guess does anyone knows how long it may take to get a interview scheduled for for a previously put on hold I-485?

Most petitioners here myself included have a pending i485 some from 2015, others 2016 and 2017 respectively..we found out that with an approved i360, your i485 case joins a fresh queue..some go faster than others..we haven't established a reason for that..but anywhere from 7 -10 months is the pattern we see the most!

you can online and there is fee calculator on USCIS official web site if you use that it will clearly indicate no fees for EAD and advance parole as long as it is under c09 category and your green card application is pending.

 

please try to explain this to the USCIS if they have renewed my advance parole and EAD without fees then thus is for every one.

 

please also try to involve your Congress person so that he can send a serious inquiry to USCIS.

Vermont in VAWA case every thing will go to Vermont

She and her son were brought into the country as K1 visa, fiancee to her previous husband a little over 5 years ago.  That marriage then resulted in a nasty divorce.  With letters being sent to USCIS  accusing her of immigration fraud.   This resulted in the cancellation of a I-485 that was in process several years ago.  After her divorce she self petitioned under VAWA using a lawyer, which is still in process right now.  That I-485 was submitted about 18 months ago.  (which seems a long time to be in process?)  She has maintained legal status through all of this with work authorizations.  Her lawyer told her that her current petition is invalid now and she needs to refile everything because they recently married.

Yes her l360 Vawa is not valid anymore because she got married before final adjudication of her l360 self petition.Vawa is taking 14/19months to be adjudicated.

 

Her chance to have the green card approved is almost non-existent because her previous green card was canceled based on fraud  .We have several decisions of the BIA and of the Court of appeals regarding this matter.

 

Legally speaking she must leave the Country and wait abroad for her CR1 visa to be approved ,and if she is out of status she will need a waiver to overcome the inadmissibility.The k1 visa is valid only to marry the original petitioner, but  the Court Of Appeal for the fifth circuit ruled that the K1 petitioner got married to the original petitioner,divorced and remarried again then the person could adjust status here because the intent to get married was fulfilled . Her attorney should look if there is any decision similar in her State.

You can check the option YES and once the Vawa is approved you will receive the EAD category C31, but if you will file l765 category C9 you will receive the EAD before Vawa approval.

You will not get any information about your Vawa over the phone ,it’s prohibited by VAWA Law,even to check something simple they won’t give you any information.

@sandranj and all other members on this forum ,I want to ask the procedure to renew my EAD under category co9,I got it through the marriage petition but had to file i360 and they held my i485 and send it to Vermont,so I want to ask if I’m suppose to pay for the renewal ?

i have question hope its in right place.. 

 

i recently did biopsy and during the test the doctor find Vulvodynia .. he said that this happened because the sexual abuse. 

 

He worte this down, Do you think i need to send it to USCIS now or to wait for RFE?
