She and her son were brought into the country as K1 visa, fiancee to her previous husband a little over 5 years ago.  That marriage then resulted in a nasty divorce.  With letters being sent to USCIS  accusing her of immigration fraud.   This resulted in the cancellation of a I-485 that was in process several years ago.  After her divorce she self petitioned under VAWA using a lawyer, which is still in process right now.  That I-485 was submitted about 18 months ago.  (which seems a long time to be in process?)  She has maintained legal status through all of this with work authorizations.  Her lawyer told her that her current petition is invalid now and she needs to refile everything because they recently married.  

 

@sandranj they advised the poster that they will not be able to AOS in the US by filing another I-130, I-130a, and I-485 because she entered the country on a K visa, is that true?

Apparently USCIS rejected my C09 EAD renewal package even when I sent a fee waiver. Seems I’ll have to pay for it. Never paid for a renewal ever but the situation with USCIS is changing. Plus I received the rejection notice and all my forms back after a month! SMH 🤦‍♀️

I’m holding sending it back for renewal. Yes, my interview is coming up and I pray I get my GC approved on spot. This renewal thing will be a thing of the past. Prayers requested 🙏

That's an interesting read but not relevant to the situation.

 

@Pinkrlion was her 360 approved before she remarried? If not then she can not get approved for it. If the 360 was approved and the 485 is pending thats different. VAWA policies say you can't get remarried during 360 process or they can't approve it.

 

If she was a k and is no longer able to get approved on the 360 due to remarriage she will have to apply and do what others who have no status to adjust from in the US do. It involves filing all the paperwork here and then leaving US for consular approval. Waiver will be pre done.

Lately I have seen that USCIS has to pay for renewals, when is your interview?

Remember and don’t feel discourage not everyone gets approved on the spot some is us had to wait 1,2,...weeks after interview but hoping yours gets approve on the spot!

From what poster stated I-360 has not been approved as she filed 18 months ago. They have been married 3 months.

First time applied with a fee waiver. They changed the criteria for a fee waiver so now a lot of people are getting their fee waiver rejected and have to pay for EAD Renewal. 

 

Same thing happened to me, they returned my EAD Renewal 3 times for payment. After I paid, then I got my renewal card.

Wow..that’s serious. Meaning, when I receive my Vawa receipt and renew my current EAD . I have to include a check of 410 ? Is that the right amount ?

Dear house 

I applied for my EAD renewal in the March under c09 category and I applied for both EAD and advance parole I have not paid any fees and whiting 3 months got my renew combo card.

 

you can online and there is fee calculator on USCIS official web site if you use that it will clearly indicate no fees for EAD and advance parole as long as it is under c09 category and your green card application is pending.

 

please try to explain this to the USCIS if they have renewed my advance parole and EAD without fees then thus is for every one.

 

please also try to involve your Congress person so that he can send a serious inquiry to USCIS.
