Dear all,

I have a question regarding I-360 form

On page 14 item 12:

I am currently residing in the United States and I request an Employment Authorization Document.

If I am planning to file 360 485 765 131 concurrently what is the difference of this option?

 

My concern is if I check "yes", can I still get C9 EAD based on pending 485 within a few months after I submit this application?

I heard someone said if check "yes", they will not issue c9 EAD either. Is that true?

My time is urgent. I don't want to wait 2 years to just get a c31 EAD.

You can file concurrently if your spouse is a USC, you will be issued EAD C9 before your i360 is approved! That way you won't have to wait for i360 to be approved to receive a work permit!

Good morning, when you say concurrently. What do you mean ? I checked yes for that question. And I have a pending I-485 and I-765 since July 2017. Do I need to submit another 485 ? Or just wait to see if the officer will hold it . 

 

Please, note that I attached my 485 and I -130 RECEIPTS (NOA)  to my vawa application already .

It means to file those petitions simultaneously,....at the same time dear. You do not need to file another i485 at this time..but did you request for the officer to hold it for you? If yes then most likely it's been held!😊👍

Ohh okay . 

 

I’ve heard nothing yet on my marriage interview since January this year. So, if they are planning on a stoke interview I’ll use the opportunity to ask the officer to hold my 485 until vawa is approved.

If he or she declines, all because they want us to pay another fee for a new 485 then I’ll just file a new 485 and 765 with the C09 category.

It may not come to that, but in the event that your i485 is denied, you can always file a fresh one dear..and you're always welcome!😊👍

I-360 Form is separate from  I-765.

On the I-360 form Page 14 Item 12 Check "yes" with this choice once I-360 is approve they will issue an EAD C31 category. In the form I-765 please choose category C09 pending AOS since you filling together with I-485, you will received EAD C09 between 5-9 months while you wait on the I-360 approval. (Most people received on hand two EAD C09 and C31 totally normal )

USCIS adjudicates every petition separately with the information you input if you request C09 on I-765 they will issue that category base on the specific qualification.

Unfortunately USCIS will only provide your information in writing because is Vawa case. I know you out of the country you may write an notarized letter to Vermont service center with your request, sent copy of your passport and A# since before you filed K1 visa. Alien # don't change. You can use USPS tracking mail service since they delivery worldwide.

Thanks, I understood everything by mail, but I also want someone who knows both English and Russian to explain to me. I will be grateful.
1. Does it make sense to call and clarify by phone?
2. It is necessary or waiting or sending again additional documents all that I have.

1. You can called but the officer will not provide you information on your case. This is the policy on abuse cases. 

2. Is best to sent additional evidence once you have your I-360 Receipt. This is your case # and any evidence should be sent with the copy of I-360 receipt or blue paper that Vermont also provide for this. 

When did you sent your package? please give it 8 weeks max, no answer maybe need to resend including a tracking # as proof of delivery.
