I am truly confused at this point .

if your IO denies to hold your 485 on hold at the marriage based interview .

then you can refile a new AOS and can be C09 category ( USC spouse ) 

this is called as concurrent filing of 360 with new 485 ( AOS ) .., then you wait for 7/9 months for your EAD C09 to come through this new AOS .

then why was it told that the person needs to wait for C31 EAD

Why ? 

This is really confusing me ...

 

also a few days ago Sandra clarifies to Villanova post that if IO refuses to put your marriage based 485 on hold then you simply can file a new AOS with C09 category the next day ( if your spouse is USC ) and u will receive EAD in 6/9 months.

 

yet so many lawyers misguide you and say 485 cannot be filed until I-360 is approved even when your spouse is USC 

 

i want everybody to get a clarification on this because VAWA takes time and if we can work during this time then we should not get misguided and misinformed and lose that opportunity to work just because these lawyers misinformed us 

 

please people pour in your opinions and help us through

That's all the opinion there is!😊 Sandra tries her best to set the record straight, even though nobody is perfect..she gets it right majority of the times! What she said right there is the truth like I've told you severally in private!👍

Dear many blessing to you.

Not to put your hopes down, but if you file a new I-485 & I-765 concurrently with I-360 to Vermont Center on September 2018, after your marriage base I-485 was denied, I think this updated is on the I-765 page and not on the I-360 page, I think this I-765 is category c09 base on the new I-485 you filed and have pending with Vermont Center. You can confirm this with the receipts you received when you filed all 3 application each application have a unique receipt number.  The massages of we order you new card should be in the I-360 page to be category C31 base specifically on Vawa approval, but instead the message is on the I-765 page which you filed concurrently with i-360 & I-485.  This is also a good news... But if you still not sure wait to received EAD on hand to check the category.

I was actually endorsing what Sandra said so that it helps other members to be educated so that the lawyers don’t misguide them. I was highlighting what Sandra said and how valuable it is so that members can be educated .

 

i have been misguided by several lawyers on this very topic ..lost money on these lawyers on the very same thing. i was told I can’t file AOS until vawa is approved . Other one said I can file AOS but wait for C31 ... not one lawyer said I can use C09 EAD ... not one ...one said pending AOS is the only way to get C09 and if IO denied then there is no pending AOS. I argued that new AOS concurrently filed with I-360 is also a pending AOS otherwise what good is that ? Why would anyone refile a new AOS if that doesn’t help with C09 EAD ? And newly filed AOS should be a pending AOS too ? Then they still would say no you won’t get C09 !!! .one lawyer used terminology as concurrently means have to be on SAME day .., the other one said concurrently filing can be 3 months apart too .. 

i have been given the run around far too long . That’s why I wanted everyone to know that Sandra knows best ... please refer to her and cross verify all information from your lawyer with her .

The only Category that needs to WAIT to file I-485 concurrently with I-360 is Self-petitioning battery spouse of an LPR (Legal permanent resident / Green card holder)  All immediate relative of an US CITIZENS can file concurrently with I-360 and also including  I-765 c09 / I-131. Vivid proof is this forum with some many Us citizen abuse spouse who have applied and have filed concurrently and have received I-765 c09 category.
