Timeline

My nephew has tourist visa so he is coming again to visit my sister .Our doubt is since she applied last year for bringing him , is the first time he is  coming after that so will it a problem when he arrives because on the computer will show he has process for green card? Will be allowed for

his entrance or will be canceled his tourist visa ?

Have nephew always carry with him on travel proof of ties to home country- studies, work, medical appointments, bank info, and similar.

Yes, the 2 times he came before my sister petitioned for him, he showed ties like job,bank account etc. My concern is when many years ago , in 2008 I applied student visa to my son and the Consulate in Brazil said he could not receive any temporary visa because he had process for green car so he had to wait in Brazil because temporary visa can not to show immigration intention and he had it.

There is always a risk he will be turned back at the border if he does not have sufficient proof of ties, this happens, but it also happens that many people with immigrant petitions underway successfully visit the US on existing B2 visas or VWP. It is definitely not a certain refusal at the border, but no-one can guarantee you that he will be allowed in, either. It will depend on the evidence of ties he has and the CBP officer's judgement of that.

My sister in-law came several times on a tourist visa while her F2-B was pending. It was never questioned upon entry to the USA. When she had her F2-B interview, her tourist visits were never an issue.

We are the poster children for chain migration!
