@Daphne K your explanation is clearer and better and i appreciate the clarification, thank you so much. Yeah, i just need to figure out that divorce decree thing, whether to include it or not.

No, you do not include it.  You attach evidence of valid and ongoing current marriage alllllll the way back to when you first got married.

Yes, you both attend the interview

Yes, you are JOINTLY filing, which is why the above has to happen

There is a list of categories to not file jointly in the instructions, but based on what you’ve said here those don’t apply.

If:  You file jointly on the basis of ongoing marriage then send her to the interview alone she’s pretty much hosed.

Hope that clears things up

@Mollie09it doesnt really matter to me as what i need to know is if i/we need to include the divorce decree, and not to figure out who the beneficiary or the recipient is. All i know is i am the usc. ok?

Correct terminology is absolutely paramount in understanding the immigration process......have you taken a look at the VJ guide for ROC?  It has a very good list of items to include.....  https://www.visajourney.com/content/751guide/

There is no reason to include previous divorce documents.....good luck

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

For ROC spouses are always interviewed with the immigrant. They want to see if the marriage is real

This was not the case always. I came under a K1 in 2015 and my AOS and I-751 interview were waived. This is not the case now

Ok. Maybe there is some confusion here, I was referring to couples who do get interviewed. My wife and I was not interviewed for ROC either. The OP was asking about cases that get interviewed for ROC, not if cases get waived for interviews.

And for cases that do get interviewed, yes, the spouse is always interviewed with the immigrant.
