What a joke this system is. If you ask me, if the Petitioner is in the USA and the fiance is in her home country, that would be considered a FAKE relationship because two people who truly love each other need to be together. Not spending time apart..

Also, how does having a job right now guarantee it the next day? Like a said, the laws in this country are a joke. And Im a 7th Generation American.....

People who truly love their wife/fiance won’t take the risk of having them locked up.

Advice is to look ahead to AOS and make sure that you are in a position to take responsibility for her.

There is also a steep penalty for falsifying an affidavit.  That one is on you.

Good luck.

Please note that it’s up to the discretion of the officer. MOST officers want to see 125% poverty line not 100%.

there are people who have made over 125% who have been asked for a cosponsor due to circumstances.

Idk if K1 is different from CR1 in this sense but, shouldn’t you only have to show them your 2018 tax returns?

No.  The requirements of the Affidavit of Support (both the I-134 and the I-864) is more than the most recent tax return.  Current income and current employment matters.

One must show current income. Unless you are self employed, tax returns only show past income.

Wow. Just wow. Why ask then if you already know your answers

He already knows better than @missileman and @geowrian . It looks like one of those common "world" people.

1. Long distance relationship is real, welcome to 21st century, where it's made possible by INTERNET. Great thing, isn't it?

2. As many pointed out, Your income is $0 right now, neither i am, nor my friends or family, nor anyone in this forum is willing to pay for your S/O when she moves here and you have nothing to support her with.

3. Laws are there for a reason. Don't like the rules? Don't play. Very simple solution.

4. Most of the time, by the way, consulates/embassies look at 125% poverty line, not 100%, just cause you'll be adjusting soon anyway.

5. Adjust anytime, up to you. It is against the law. You could test it out for us, to see how long You could last with expired K1 until you deported. (don't. It's sarcasm)

6. By being 7th generation American, you should know all of these. Ignorance isn't an excuse.

Good luck on your voyage.
