Hi everyone, I am currently in the process of filing for a K-1 visa. In fact, I will be sending my paperwork out tomarrow to California!! I am expecting everything will be fine, up until my fiancee's interview. I read that I must provide the last 3 years of income. Currently, I am making above the poverty level, but in 2004 I really did not make anything due to me moving across country. I moved back into my parents house and did not work for awhile. So, to tell the honest truth, 2004 income does not look good, 2005 looks o.k. and 2006 is great as far as the guidlines go. My father said he would be more than happy to help as being a co sponser. I have read that you can't have a cosponser when filing for k-1. Is there any way he can actually be the primary sponser and me the co sponser. I am really nervous, I just do not want anything to go wrong. Anything anybody can tell me, I would be more than grateful. Thank you soo much!!

I have read that you can't have a cosponser when filing for k-1. Is there any way he can actually be the primary sponser and me the co sponser.

I'm waiting for my fiance to file our I-129F so I'm not the oracle on this, but you can have a co-sponsor when filing a K-1. I think there's no way he can be primary sponsor, since it's your fiance and not his, but he can co-sponsor provided he meets the income requirement.

They are most concerned with your current income, and most recent year's income, Provide a letter from employer and past few month's pay-stubs, don't worry about 2004.

I don't think you will have a problem, If your current and future income is sufficient, you should be fine.

I am in exactly same position - 2004 income was not so great, but very good now. I don't think it is a problem - they care what you make now and how good your job is. They don't care about your past.

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

Correct, though the petitioner is still the Primary sponsor, this is especially so later when adjusting status, the petitioner MUST be the primary sponsor of the immigrant, but can have a Joint sponsor if income is below 125% poverty line.

There actually has been a lot of debate on this topic here. I personaly was looking up the information on a co-sponcership for the philippines. the general consensus is that in the manila embassy they have been known to not allow a co-sponser for the k visas.

There is a topic in the philippines regional forums on this. or used to be. If i were not so lazy i would pull it up for you.

We have the same case. In 2004 he fall in bankruptcy, now he is back ok again, but numbers didnt look good. Get letter from employer stating about income, your bank stubs, and any funds and investments. This shouldn't cause denial, because in present time you are making what required. And there is always possibility of co-sponsor.

08/28/2006 - NOA2 - approved

09/01/2006 - NVC - approved

09/07/2006 - Warsaw embassy sent packet 3 (damn post services, never received any)

09/18/2006 - packet 3 sent (Nothing fails)

09/27 - received packet 4

10/10 - medical exam

10/19 - INTERVIEW!

10/20 - received visa

11/7 - arrived in USA, POE YFK

1/19 - Married

02/23/2007 - Civil Surgeon (checked just vaccines for $ 25)

05/04/2007 - AOS package sent to Chicago

05/11/2007 - NOA1

05/15/2007 - NOA2 - ASC appointment letter about biometrics

05/24/2007 - RFE about tax forms w-2 and 1099!!!

06/05/2007 - Biometrics

21/06/2007 - NOA3 - Transfered to California

10/07/2007 - AOS approved, card production ordered!!!

19/07/2007 - Half year marriage anniversary - GC arrives!!!
