Question - Is that the way it has to be? I don't mind doing it either but I'm curious

Aloha! To the best of my knowledge USCIS does not provide specific guidelines for cover letters. We were uncertain as well so we just crafted the cover letter to be from both of us. Since the "Petitioner" is the immigrating spouse, we put my immigrating spouse first, and me (USC) second.

 

Here's how our cover letter opens:

"Dear Madam or Sir:

Enclosed please find Form I-751 and evidentiary materials to support Removal of Conditions on Residence for Mr. (full name of petitioner). USCIS granted Mr. (last name of petitioner) Conditional Permanent Residence on (month, day, year)."

 

The letter then gives a brief summary of the petition, and closes by thanking the reviewer for their time and consideration. We both signed at the bottom and included our dates and places of birth. The letter (one-page) was then followed by a four-page Table of Contents.

Thanks. Since I'm writing the cover letter I naturally narrate as myself and was unsure. Addressing the whole letter as 'us' sounds like the best way.

Hello all,

 

I wanted to share this unexpected detail with my fellow August 2019 filers.  We just received an e-mail yesterday informing that our case was transferred from SRC (Texas) to another office.  We've not received the transfer notice itself in the mail yet, so we don't know yet which office we have been transferred to or why.  Below is a reminder of our timeline:

 

8/19/2019 (Monday):  I-751 package sent (Dallas Lockbox)

8/20/2019 (Tuesday):  Package arrived.

8/21/2019 (Wednesday):  Picked up by USCIS.

8/23/2019 (Friday):  Text notification and e-mail received with SRC case number (Texas Service Center)

8/26/2019 (Monday):  Received I-797 Extension Notice (check cashed same day)

9/6/2019 (Friday):  Received e-mail informing of transfer out of SRC (e-mail with status "initial review" says new office and reason for transfer will be stated in the letter that has been sent out).

 

Granted, transfers are not uncommon to balance workload at USCIS offices, but this early in the process??  (We're only two weeks in).  I'm intrigued.  Any theories what might be going on?  Has anyone heard of similar scenarios, especially with recent I-751 submissions?  Thanks in advance for your feedback.

Hi guys, USCIS sent my documents back. It says " was received prior to the90-day period immediately preceding the expiration date of your I-551 card.'

My exp is 11/16. And my documents were received on 8/17. Is it because it says 8/14 on my application.

And can I send the same documents back again with an updated I-751? Would they also have let me know if anything was missing or incorrect on the documents?

8/17 is 91 days before 11/16. You filed (and signed) too early. Yes you'll need to file again with updated I-751 dated WITHIN the 90-day period. Chances are they didn't even review the rest of your submission because it was received too early.

 

Remember folks, unless the entire month of February falls within your filing window, "three months" is more than 90 days!

It seems like they did because everything has a scanned note on the bottom, photos were replaced to another envelope and things were in all different order.

There's a difference between scanning/sorting and reviewing. I wouldn't assume they would let you know if something else was wrong. This is a good opportunity to re-review your petition and evidence and do some research on what's recommended and what other people included. There are a couple of posters in this August 2019 thread who had their petitions returned (either for filing too early or sending to the wrong location) so I'd suggest reaching out to them to find out if they sent in their returned originals (with a fresh I-751) or if they re-printed everything. As far as I recall their second submissions were accepted successfully.

Sunday 8/25/2019:  I-751 package sent from Raleigh, NC via FedEx 2-day for $25

Wednesday 8/28/2019: Received and signed for at USCIS Phoenix, AZ at 10:30am according to FedEx tracking

No email, no text from USCIS.  I paper clipped the email/text form to the cover letter.  I don't think that's the best way to do it.  I assume the form got unclipped and lost?

Monday 9/2/2019: Labor day

Wednesday 9/4/2019: Check cashed according to bank account online lookup

Saturday 9/7/2019: 18 month extension notice received in the mail.  Assigned to Potomac Service Center (YSC).
