Hi folks-we have stared filing out the forms we think we need. Betty came here on an I-94, we married just as it expired in Dec, 06. Here are the forms I am planning to file. Since we live in San Diego I'm assuming I mail them to the Chicago Lock Box.

I-485 Adjust status form

G-325A Biographic Data Sheet

I-693 Medical exam

I-804 Affidavit of Support

I-765 Authorization for Employment

My questions are:

Do we file the I-693 at the same time as the I-485 or send it later upon request of wait 'til the interview?

Do I really need to fill out the I-804 as her new husband? I don't have any problem with it, just hate the thought of plowing through it (lol).

And yes, we really do want her to work. She needs a normal life.

An I-94 is not a visa, what visa are we talking about? K-1, K-3, or some other type of non immigrant?

Yu and Dan, it doesn't take much imagination to realise that the spouse entered on a K-1 Visa, no way she could have entered on a K-3, seeing as they married after the spouse entered the US.

Yes, you need to fill out the affidavit of support and yes, send in the medical with all the other documents. Good luck to you!

Yes, you need to complete the medical exam BEFORE filing for AOS. The civil surgeon must be authorized by USCIS. To locate an authorized civil surgeon in your area see https://egov.uscis.gov/crisgwi/go?action=of...office_type=CIV . After the exam the civil surgeon will give you a sealed envelop containing her medical results and vaccination record (I-693 and I-693A). Don't open it, just attach it to your AOS file.

Yes, you need to file a I-864 Affidavit of support as her sponsor.

Read the guides (link above) and the instructions on every single form you need, follow them and you will be fine.

The OP was not clear, and not having details like Visa type that they entered on does not help me answer question with any degree of accuracy, I look at things like timeline, and profile details to help formulate an accurate answer, I tend to not look at prior posts. A later replier noted B1/B2 visa, which makes your assumption wrong also.

So answer is please read the AOS guide from other types of visa.

Affidavit of Support form number is I-864, you sure have to fill it.

You get I-693 from your civil surgeon in sealed envelope before and send this with your AOS.

When you send check, put these fees separated.

EAD is good thing, but we didn't apply. Now we know we did right, because if you get RFE, they stop EAD process for 90 days.

This is how looked our package:

- Payment in the amount of $ 395 ($ 325 I-485 filling fee and $ 70 fingerprint fee)

- Form I-485, Application to Register Permanent Residence or Adjust Status

- Photocopy of petitioner’s passport biographic page

- Photocopy of petitioner’s US visa

- Photocopy of form I-797, Notification of action Approval for I-129F

- Photocopy of petitioner’s I-94 front and back

- Photocopy of petitioner’s birth certificate original

- Photocopy of petitioner’s birth certificate notarized translation

- Certified copy of marriage certificate

Ok everybody-many many thanks for all of your replies, we know everyone is trying to help eachother and we got a lot of very good information. Yu, sorry for not mentioning the B1 thing, you had no way to know, my bad. We are aware of the sealed envelope and have a list of Civil Surgons in our area. Betty has many other friends here from Indonesia and not all of them have been through this, we're just a little (haha-a lot) nervous, but we're going for it before the prices go up. If she entered on a B2 visa, you need to file I-130 as well - Jane2005 has already advised you on that. And you really have to fill out I-864 affidavit of support. Good luck! :)

you will see all that you need to file. Your wife is not a US Citizen so therefore is an Alien and she is your wife so therefore is a relative. As I understand it having not gone through other visas like K-1/K-3 your wife will need an Alien registration # the I-130 is how you will get this and inform the USCIS of your marriage to someone wishing to remain in the US.

Interesting; why an I-130? Isn't this a petition for an alien realeative? We were told we could file this later when we are ready to bring some releatives over?

You'd also need to file an I-130 if you haven't already.

The I-130 makes available a immigrant number immediately to you. It is on the basis of this (in regards to your marriage to a US citizen) that you will adjust your status.

Where alot of people get confused is that they believe that just the marriage alone is enough to adjust status but you actually have to file the I-130 inconjuction with the I-485. Disregard the instructions on where to send the I-130, for you it will all go to Chicago in one big packet.

Filing for a CR or IR while the spouse is overseas, it goes to the service center.
