Well as denials go that doesn't seem to be too bad. If you were denied for showing false documents or something like that it would be much worse. Simply not having enough evidence is something that can change given time. It seems logical to think once you have the sufficient evidence you should be able to reapply successfully.

What did you submit with the initial application?

What further evidence do you have now to submit with the 2nd?

 

Answering those 2 questions can help members assist you in determining if it's a sufficient package the 2nd time around..

If you've been together now for three years you presumably have the assets to prove it (joint bank accounts, perhaps a car in both your names, perhaps you are a beneficiary to his 401k) -- if so, file again now.

Be prepared for the eternal waiting game. Be prepared for average news.

evidences we provided

5 sworn affidavits ( family and friends) 

pics from wedding and other outings

my husbands orders (he’s mill and had to PCs)

his insurance with me as a beneficiary 

my mill benifits card

his car insurance with my name on it

labels from packages that shows we shared same living arrangements  

( some things we couldn’t get due to the fact that I had no social number) eg joint bank account, lease and a plethora of other stuff

Yeah...USCIS likes to mainly see co-mingling of finances..

Affidavits are secondary pieces of evidence.

 

I'd work on getting your name added  to the bank account, as well as the utility bills (don't need to present a SSN number for that).

 

Tax returns where it lists you as the spouse are a good piece of evidence as well---he *did* file as Married Filing Jointly, or Married Filing Separately over the past 3 years since your union, right?

We moved and he basically stationed in a next country while I’m living with my mom. We share the bills in the house and my husband stands for food and the cable so he pays for that monthly. He was able to get me a credit card one in my name and one in his since he won’t be here to literally hand me money while he’s away. And yes the taxes were filed as married. That’s basically all we have so far but the lawyer says it looks good because we have longevity. We don’t have a choice where my husband is concerned because the us army basically owns him.

If the credit card is a shared one, you need a printout of some statements showing both names.  You should do multiple credit cards, not just one, if possible.

 

There are a lot of utilities that won't show both names or only allow one person as the account holder.

 

Some of the things I did, which I am providing as examples to get your mind working in the right direction:

  1. I opened additional life insurance policies (so employer one plus an new one we did on our own).
  2. Provided Pre-Nup and Will/Testment, Living Will
  3. Showed my husband was beneficiary on all of my 401ks/pensions/IRAs.
  4. I was able to add my husband to home insurance before he moved here and I provided a printout of the policy
  5. I was able to add my husband to my car insurance (with a jump in premium) so I could provide a printout of our policy
  6. I refinanced my home and as part of that he was added to the deed but not the mortgage.  He signed the paperwork on a visit before he moved here and I provided a printout of the deed change.
  7. I *think* I was able to have my husband as beneficary to my stocks I received from current and former employers.

Basically, ANYTHING I could add his name to I did.  And then I showed paperwork for it all.  Hell, I even provided a dog adoption application with our names on it :)

yes,  2nd ones can  be approved with addtional evidence

 

He needs to add you to tax returns by doing W7 for ITIN for alien spouse

then with the ITIN ,  he can add you to bank account as per federal banking rules

 

I did this for my husband and did the 2nd CR1 (IR1) and we were approved

2010 marriage

added him to 2010 tax returns

2011 denied

added him to bank account in 2011 or 2012 ?/?? after getting ITIN

2012 appeal (don't do just reapply as this can take years)

2013 won appeal and reapplied

Nebraska was slow and NVC lost paperwork for a few months

interview 2015 and visa approved
