I will be applying for an AB60 license when I move, most definitely. It’s not an ‘illegal license’ and using and owning one doesn’t mean that you are necessarily illegally in the country - just that you don’t have proof of legal presence...not having proof is not the same as it not existing (though I appreciate that may be why many...not all...use it).

 

I’m certain there won’t be any ‘consequences’ of having an AB60, as it’s a completely legal license, issued by the DMV.

 

I want to be able to drive when my family come out to visit me for the wedding in February, so I plan to get an AB60 license initially and will then upgrade to a regular license after EAD etc.

Be aware that if you go to secondary review, you'll have a wait.  I applied for AB 60 on Aug 14, they sent copies of my passport and residency docs to secondary review and now I have to wait for a letter with an interview date at, what the DMV tells me, is a very busy office that may be booked far into the future.  And THEN I'll have to wait for another letter in order to book a behind the wheel test which in my area (LA) is likely a few months wait.  Plus side - the AB 60 is good for 5 years and you may not get a secondary review.  You're right though, it's not strictly for illegals and if your documentation is in order, it isn't "risky" in the least.

A requirement to submit an AB 60 application is to affirm under penalty of perjury that you are unable to submit satisfactory proof (per the first section of the relevant PDF) of legal presence in the US. Thus, you can only legally submit an AB 60 application after your I-94 expires; CA DMV doesn't accept AOS NOA1 as satisfactory proof of legal presence.

That actually raises many questions which I doubt that they have thought through.

They accepted my unexpired I-94.  They require 60 days left on it and I had less than that, I assume that's why.

Was it also less than 30 days? https://www.dmv.ca.gov/portal/dmv/detail/pubs/brochures/fast_facts/ffdl32/ "You may start your DL/ID card application if you have an SSN and your BD/LP document expires more than 30 days from the day you apply. However, if your BD/LP document expires less than 60 days from the day you apply, DMV will let you take all the tests, but you will not receive your photo DL/ID card until you provide a BD/LP document which is valid for 60 days or more from the day you applied for your DL/ID card."

The secondary review to get AB60 might take more than 90 days. To me it's not worth it cause EAD/AP might be approved sooner and you can apply for DL with real ID

Not everybody can expedite EAD.

I got EAD/AP approved in 3 months without having to expedite. DL can be renewed once EAD/AP in hands. The key is apply for DL when I-94 is valid for more than 60 days and get an appointment in less busy DMV office

3 months for EAD without an expedite is very unusual.
