I am a permanent resident in florida. I should be a us citizen by august/ september, 2007. I am currently engaged, to a girl in india and i was wondering, i would be able to apply for k1 visa from india or do i have to apply for k1 visa from the US. If so what is the process and how long should it take for her to receive k1 visa.

I believe you should apply for a K1 visa while resident in the US . I am not sure if the K1 is open to LPRs so you would have to file a petition after you obtain your citizenship. The whole process takes about 6-9 months depending on how fast your consulate processes the case.

That's right, K1 option is only available for Fiances of US Citizens. If you're a permanent resident you would have to marry her first and then file a petition on Form I-130 and your spouse would have to wait overseas until her green card is ready. Or you could wait until you become a citizen and then you'd be able to apply for a K-1 or K-3. Not sure how long does it take for spouses of U.S. residents to get a green card but I've heard it could take years.

Yes K1 is only available for fiances of US Citizens but the OP will be a citizen in a few months. He must wait to file the petition until after he has proof of US Citizenship. The "proof" is required with the petition.

My best recommendation is to maintain at least a domicile address in the US. As a US Citizen it doesn't matter whether you mail the petition from the US or elsewhere, as long as you have a US domicile address. Sure, as a USC you can file while you're visiting your fiance in India and visit as long as you are allowed.

Congrats on your upcoming citizenship! Here's the guide VJ has for filing K1: http://www.visajourney.com/forums/index.ph...mp;page=k1guide I dont understand what you mean can you file K1 from India? You must send the paperwork to USCIS, but you can be in India and mail it from there.
