For the I864 it asks for the last years' tax return, however we have not filed our 2005 taxes yet, so we don't have any to give. Instead I am sending in 2004. I don't think this should be a problem considering the deadline to file your taxes has not yet passed.

Any thoughts? I assume they may just ask for an updated I864 when we have our interview for AOS.

Although we submitted our AOS last year, we had our interview a couple of weeks ago. At the time we hadn't filed 2005 taxes, so we took along my W2 as evidence of continuing income. The interviewer wasn't interested in the slightest.

Perhaps in your case, when your interview date is assigned, you can take a copy of your 2005 taxes with you just in case they ask for it. I think it is unlikely that they'll ask for an updated I-864, but then again, you just never know with USCIS.

Yes. Don't worry about sending in the 2005 tax returns with the I485 packet - you can take them with you at the time of the interview. I had them done but didn't even take them with me as the interview was in February. Good Luck

I-864 asks for tax returns for most recent 3 tax years. So if you have not filed for 2005 yet then you should only need to submit 2002, 2003 and 2004 and should not have a problem.

I am sure when it's time for the interview they will ask and want to see more which by then you will have.

The I-864 was updated in November 2005 to ask for only one year's tax returns. However, filing three might not necessarily be a bad idea. In any measure, 2004 is probably fine and you can just show them 2005 at the interview.

Hummmmmmmmmm..... interesting....... I guess USCIS has not updated their web sight I-864 instructions. As it still states to include 3 years of tax returns.

One thing i noticed (and I know i'm being too literal/#######/obsessive in reading the affidavit form) is that it says

"A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year"

I'm guessing they mean this relative to the applicant/petitioner, as opposed to "the most recent tax year" which would be objective, i.e. 2005??

Between the time we filed AOS (Jan 2005), and had the interview (June 2005), we filed our 2004 taxes. We took a copy of our printout (we use TurboTax) with us to the interview, and the adjudicator took it and added it to our file. He expected us to have it with us, and asked for it.

If you do your own taxes, take the return down to the IRS office in your area (if you can do so) and ask for a stamped photocopy that confirms you've filed it with them. This is important to have if you know that your transcript may not be on file right away. Alternately, if you efile, have copies as Cassie mentioned from TurboTax/Quicken/any other sort of accounting-efiling software.

H&R Block or Jackson-Hewitt, among others, can prepare your return and it may be worth the $40-80 it costs to have the nicely made package put together for your interview. I've filed all my and my husband's taxes before but we went with the professionals because this whole 'joint married filing' business is new to both of us and we weren't sure how all the legal mumbo jumbo worked out.

These are just suggestions, but any time after April 15th-ish, it's probably expected you'll bring your W2s, tax return/transcript and whatnot for 2005.
