hi there,

I'm so nervous...My fiance and me got an RFE. They wanted more evidence that we really have met in the last 2 years...we did send everything out on the 14th of March and they sent us an email that they recived it on march 15th...since that day we are waiting. They haven't touched it anymore...is that a bad sign??

How long does it usually take until they approve it??

We sent an other plane ticket when we went on vacation together...a hotel receipt when he visited me in germany some other entrence tickets when we went to places here in germany. More pictures, a letter from his mom and his aunt. Emails we sent each other, maybe some more things but I can't think of it right now...

We did actually send a lot of stuff out the first time. Pictures, emails, letters, plane tickets (when rusty came to visit me here in germany, and when I flew over to see him), phonebills...everything they asked for...

Thats why I don't really understand why we got an RFE...oh well...

Thats why I don't really understand why we got an RFE...oh well...

emails, letters, phone bills are not evidence of having met.......and if you submitted little or nothing other then plane tickets and photos that is often not enuf to convince them. Sometimes it can be but each case is different. Photos are generally secondary evidence.

Evidence of having met and relationship evidence are two completely seperate things.

"They" did not ask for relationship evidence. Pictures, emails, letters phone bills do not constitute proof of having met.

The evidence they're looking for is documented proof such as, but not limited to: Passport exit/entry stamps, boarding passes, credit card/atm receipts drawn on your account in the place you assert you met, and possibly a photo of the two you. Any documented evidence that you and your S.O. were in the same place at the same time and of course the time you assert (within the past two years).

I feel your pain! I have a rfe from vermont and I'm still waiting to know what it is. I think they are really spitting these things out lately. Any other Vermonters with a rfe lately? How are pictures secondary? it clearly shows that the two of you have been physically together. I sent 5 pictures from each of my trips to see him and 2 for his trip here as well at the greyhound bus stubs for each trip that has the date and my name on them. So i don't know why i got one either. literally. anyone call a centre after waiting two weeks for the rfe to come in the mail and it hasn't yet that had any luck figuring out what it was for?

What you submitted with the RFE is more in line with evidence of having met. A mix of primary and secondary evidence to bolster up your initial evidence.

How are pictures secondary? it clearly shows that the two of you have been physically together.

Photos are considered secondary evidence because they in themselves prove nothing. They show you have met but do not show you met within the past two years before the petition was submitted.

They can be used to supplement any primary documentary evidence but they themselves cannot stand-alone to prove your point.

The USCIS understands that photos are easily "doctored" and timestamps can be applied to any photos after the fact.

If you assert you met during the Olympics, and you have dated documentary proof in the form of entry/exit stamps and boarding passes a photo of you and you S.O. in the stadium would certainly supplement your primary evidence.

What one has to remember is that the evidence submitted has to form a picture in the minds eye of the adjudicator. Photos submitted on their own, in many cases will not satisfy the requirement. Some have managed to send only photos with little or no other supporting evidence and been approved, but many have not. Photos can be doctored. Its the strength of your evidence overall that will have the better chance of not receiving an RFE for more evidence. Photos support other primary evidence such as what Kaydee mentioned. Each case is different however and one must look at their evidence within its own circumstances.

Kaydee is correct. Can you not send in copies from your passport with the travel stamps or other evidence that show a timeframe? Good luck.
