Timeline

We have been married now since July 2018. But getting my wife and son here because of bad direction from Rapid Visa and 10 month stay in Manila hotel and cost we have yet to afford $ 2.500 plus to file AOS. My question is > are they at risk of deportation? And how long will they allow us ? 

Thanks for your replies and God Bless you all. God got them here and Im sure God will help me thru this costly process.

Yes, if the I-94 has expired then they are at risk of deportation. File the AOS immediately. Borrow the money from a friend. Deliver pizzas. Use your credit card. Drive for Uber. Do what you have to do. 

 

Will they be deported? Unlikely. But everyone who has been deported probably thought the same thing. The risk is small, but nevertheless it is real.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Timeline

90 days after arrival in the US, their I-94s expired.  Since that day, they have been subject to deportation, married or not.  Just recently, a poster (who had not filed her I-485) was in a car which was stopped by police.  As a result of being out of status, she was jailed for 5 weeks, and her case is still ongoing...........Filing the I-485 will give them "authorized stay" while their adjustment is being adjudicated......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

Take the advice to pick up a side job (uber or DoorDash or similar), or try and get a personal loan or an increase on your credit card, borrow from family or friends, sell belongings you no longer use, or a combination of all of the above. 

 

Also, use your poor planning at this stage as an opportunity to be better prepared for the removal of conditions and start saving for that now.

First, don't waste any more money on Rapid Visa or an attorney. You can do it all yourself. Second, as others have stated, start building wealth through any means necessary other than criminal activity.

Used all my savings,  lost all my credit , and never planned for financial hardship.

Ridicule of me is unjust. 

Was looking for answers only. I work hard everyday so its not laziness and have no one to borrow from and would not ask if so. But God will continue to see us thru as he has this far. Thanks

The answer is that they are, in fact, subject to deportation as they are not in legal status....and they are not , at this point, authorized to stay inside the US.  I would quickly develop a plan of action to "find" the money to file the I-485s as soon as possible......The ball is in your court......good luck...

Can you at least file for your wife, then she'll be able to work sooner rather than later?  Working opposite schedules to save for your child?

 

Ahhhhu did you guys have to stay in an hotel for 10 months? That sounds terrible  :(

But descent isnt enough when it cost $10.000.00 more than planned to get your fiance and son here. Not counting $1.200.00 for a service that failed miserably 

at giving us professional direction in our Visa process.

The AOS filing fees are a drop in the bucket relative to the actual living costs and sponsorship requirements for a spouse and child.

 

File as soon as you can. The sooner you file, the sooner your spouse can work - even a few hours - to help if needed. Also, the costs associated with not filing and dealing with immigration court + a lawyer is much higher, let alone not a good experience.
