Affidavit

Hello, 

 

We are preparing to send in the petition to remove conditions from a 2 year conditional residence green card based on marriage. We have prepared affidavits for our friends and family to submit with our paperwork attesting to the nature of our relationship.  

 

In the beginning of each letter, we included the following sentence: Being duly sworn, I depose that I am making this affirmation in connection with John Smith’s application to remove conditions of permanent residence based on marriage currently associated with his visa. 

 

All affidavits have already been signed and notarized. We wanted a second opinion on the wording of the above sentence however, because technically the green card isn’t a visa. We didn’t notice this slip in wording until too late. The important part of these letters is of course the testimony of our relationship. Will this pose an issue?

I would not worry about it, they are pretty worthless, concentrate on the important stuff.

They're not going to focus much on affidavits anyhow---that's secondary evidence.

Main focus will be the documentation/evidence of a bonafide marriage.

Surely if you’ve been living together as husband and wife for two years or so you have far better evidence than the words of some friends of yours? As if your friends would say anything other than you have a genuine marriage. That’s the reason affidavits are pretty worthless.

The primary  and strong evidences are financial intermingling and if you guys have those documents during 2 years of marriage, you will be fine.  Also you can add living will and power of attorney  of health for each other, they are better addition than affidavit from friends and family.

Many people, including me, didn't even send affidavits.  They are not required, and they don't hold much weight......anyone can produce an affidavit......they are just words on paper.
