Sponsor with no revenue, can we only use assets?

Hello,

 

Me (foreign fiancé from France) & my girlfriend (sponsor) are looking into the visa K1 application and we currently struggle with a money problem. My girlfriend has 2 children from a previous marraige and did not work because they decided that she should stay home for education - and still doesn't. But she has assets in a bank account (~$50K). I know that my income cannot be use, but i also have assets on my side (~$145K) on a bank account.

 

So if i'm taking 125% of the federal poverty guideline for 4 poeple (2 kids, my fiancée and I) the minimum requirement for 2019 is $32,187. With a total assets value of $195k, we own almost 6 times the required amount.

 

Do you think that given the current situation, we might have an issue in regard obtaining the k1 visa and afterward the green card ?

Just an FYI at the K1 stage it is only 100% of the poverty guidelines.  For assets you need at least three times that number, so you should be fine, but unless it is cash, you may also need appraisals.

Hi Julien,

 

Do you know if your consulate (Paris?) allows for self-sponsoring?  That is a consideration.

 

Best bet would be to line up a co-sponsor.

 

If your fiancé truly has no income, have you considered what you two will live on during the 6-8 months here when you will be unable to work?  Assets/savings could go pretty quickly during that time.  It is a disadvantage of the K-1 vs CR-1.

 

Btw, I love your name.  I named my baby Julian.

Hello, yeah i know about the 100%, but because we look forward to the step after that we aim at the 125% from the beggining. All of our assets are in cash.

I tried to find information about the self-sponsoring in Paris but couldn't find any. And yes we'll definitely look into the co-sponsor.

 

I have my own company (i'm a freelancer) so i could always work and earn money during that time. Also because i would be unable to work i could take care of the kids (which will be at school) meaning that she can have a job during that time (we've talked about this solution already)

Not without your EAD or Green Card you can’t.

If you want to continue working immediately after immigrating to the US , the CR-1 spousal visa is the only way you could do this.  US immigration is being very strict these days on income requirements based on their ability to broadly interpret concerns of becoming a public charge.  So a co-sponsor might be needed in your case, but that is way down the road in this long process.  Bonne chance!
